AUTHORIZING THE PlACING OF SPEED LIMIT SimJS; PRFSCRIBING A PENALTY; PRCWIDING FOR PUBUCATION; AND DEClARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF MS ORDINANCE. WHEREAS, the governing bo~, as authorized by Article 827a, Sec. S, Vernon's Annotated Penal Code, finds that certain prima facie !peed limits on certain highways are different from what is-reasonable or safe and should be altered and the iamediat·• preservation of public health and safety requires im- mediate alteration of said prima facie speed limits as hereafter set forth, -· which creates an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF lUBBOCK: .. SECTION 1. The prima .facie speed limit established by Article S27a, Sec. S, Subsection 1 (b), Vernon's Annotated Penal Code is altered and changed for all vehicles to 50 miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On West side of State Highway Spur 331 beginning at a point 2.406 miles South of 50th Street and extending South for a distance of .350 miles. SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinanceo SECTION 3. An person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum no~ toeKCeed TWO HUNDRED DOLlARS ($200.00) and for subsequent viola .. tions within one year thereafter shall be prosecuted as prescribed for such violations by Sec. 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive caption of this Ordinance together with the penalty grovieion as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be final~ p$ssed on the day or its introduction be suspended, and this Ordinance is de- clared to be an emergency measure to take effect for and after its passage.
