L .. ,~. 57) o~'waa "No. ,i:,f _; AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FROM 40 MILES PER HOUR TO 45 M:IIE; PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS: On the East side of State FM Highway S35 beginning at a point 0. 794 miles North of the Intersection of 50th Street and extending North 0.34 miles · AUTHORIZING THE PlACING OF SPEED LIMIT SIGNS; PR!SCRIBING A PENALTY; PROVIDING FOR PUBLICATION; AND DEClARING AN EMERGENCY; AND PROVIDING FOR THE !FFBCTIVE Dl 'l'E OF 'l'RIS ORDINANCE. ~S, the governing bod1, as authorized by Article 827a, Sec. 8, Vernon's Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the iizmediate preservation of public health and safety requires· im- mediate alteration of said prima facie speed limits as hereafter set forth, · which creates an emergency ; NOW' THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CI'I'I OF LUBBOCK: SECTION 1. The prima facie speed l~t established by Article S27a, See. 8, Subsection 1 (b)1 Vernon's Annotated Penal Code is altered and changed for all vehicles to 45 miles per hour on the following designated highwys or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of State l'l1 Highway 835 beginning at a point 0.794 miles North of the intersection of 50th Street and extending North 0.34 miles. SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 3. An person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not. toscceed TWO HUNDRED DOLlARS ($200o00) and for subsequent viola .. tions within one year thereafter shall be prosecuted as prescribed for such violations by See. 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive eaption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and convenience requires that this Ordinance be passed as an emergenct measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emer~ency measure to take effect for and after its passage.
