AUTHORIZING THE PlACING OF SPEED LIMIT SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PtJBLICA.TION; AND DEClARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DA.'l'E OF THIS ORDINANCE. ~S, the governing body, as authorized by Article 827a, Sec. S, Vernon•s Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the~diat• preservation of public health and safety requires· im- mediate alteration of said prima facie speed limits as hereafter set forth, -· which creates an emergency; NOW THEREFORE, BE IT ORDA.INED BY THE CITY COMMISSION OF THE CITY' OF LUBBOCK: .. SECTION 1. The prima facie speed limit established by Article 827a, See. 8, Subsection 1 (b)j Vernon's Annotated Penal Code is altered and changed for all vehicles to 55 miles per hour on the following designated highways or street in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the East side of State Highway Spur 331 beginning at the intersec- tion of 50th Street and extending South for 0.600 miles. SECTION 2. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this Ordinance. SECTION 3. An person, firm or corporation violating the prima facie speed limit established b.r this Ordinance shall upon conviction be fined in any sum not toeroeed TWO HUNDRED DOLlARS (8200.00) and for subsequent viola+- tions within one year thereafter shall be prosecuted as prescribed for such violations by See. 15 of Article 827a, VernonYs Annotated Penal Code. SECTION 4. The City Secretary is authorized and directed to cause the publication of the descriptive eaption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and co~enience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally' passed on the day of its introduction be suspended, and this Ordinance is de- clared to be an emergency measure to take effect for and after its passage.
