AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE ct'tY OF
LUBBOCK BY ADDING SECTION 14A~ PROVIDING FOR SPEGIFIC USE PERMITS
AND ZONE CHANGES; AUTHORIZING THE PLANNING AND ZONING COMMISSIO
TO RECOMMEND SPECIFIC USE PERMITS UNDER STATED CONDITIONS; EST-
ABLISHING A CLASS OF USES AND THE DISTRICTS IN WHICH SUCH USES MAY
BE GRANTED BY SUCH PERMITS; PROVIDING FOR CONSIDERATION BY THE
CITY COMMISSION; PROVIDING FOR ACCEPTANCE OF THE TERMS AND CON-
DITIONS BY THE LAND OWNERJ PLACING A TIME LIMIT TO SECURE BUILDIN
PERMITS; PROVIDING FOR AMENDMENT TO THE ZONING MAP; PROVIDING
A PENALTY FOR VIOLATION AND/OR ABATEMENT OF VIOLATIONS BY FILIN •
SUIT; AND PROVI.liNG FOR PUBLICATION AND EFFECTIVE DATE OF THIS
ORDINANCE,;
WHEREAS. the City Commission finds that provision should be made for mor
flexibility and limited uses of property in harmony with existing uses in many· are
including fringe areas, in order to meet changing conditions occasioned by Lubboc t s
growth and by the proper use of safeguards and conditions such uses and structure
can be made harmonious with abutting and nearby property-» NOW THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION._.l.; _;.'tHAT Zoning Ordinance No. 1695, being an appendix to the
Lubbock City Code~ be amended by adding a new section thereto to be designated

U 11SECTION 14-A.l SPECIFIC USE PERMITS. 11
Upon application for a zone change, the Planning and Zoning Commission may
recommend a zone change or a SPECIFIC USE PERMIT ZONE CHANGE.
14-A. 1 The City Commission of the City of Lubbock may, after public heari
and proper notice to all parties affected; and after recommendation from the Pla;n
ning and Zoning Commission containing such requirements and safeguards as are
necessary to protect aQ.j~i:ni'D.g p~operty,. authorize the location of any of the follow
ing uses in the spe~iffed districts~ PROVIDED the application shall be accompanie
by a site planrdra:\vn to scale and showing the general arrangment of the project,,
together wit:h:essential requirements such as off-street parking facilities~ locatio
of building~ and the uses to be permitte<4 means of ingress and egress to public
streets, and the type of visual screening such as walls, plantings, and fences:
14-A. 1-1 Any use or public building to be erected or used by the City,
County:~ State or Federal Government in any district.
14 .. A. 1-2 Private schools, kindergartens, and nurseries teaching the
same subjects as public elementary and high schools in any
district.
14-A. 1-3 Institutions of an educational, philanthropic~ or religous
nature(but not including churches) in any district.
14-A. 1-4 Radio broadcasting towers and stations, television towers,
and television transmitting stations in any district.

14-A. 1-5 Any installation of a public utility~ either privately or
publicly owned, in any district (but not including offices).
14-A. 1-6 Private clubs in the C-3 district or on a site of three acres
or more in any district.
14-A. 1-7 Hospitals on a site of five acres or more in any district.
14-A. 1-8 Shopping centers or related commercial developments on a
site of three acres or mare in any district.
14-A. 1-9 Private apartment projects on a minimum. site of. two and
one-half acres or on one block of street frontage betwe.en
idersecting streets, whichever is smaller in any district.
14-A. 1-10 Professional offices for architects, engineers, landscape
architects~ attorneys;~ interior decorators, and certified
public accountants, in any R-3 district.
14-A. 1-11 Public stables or riding academies on a site of ten acres
or more in any district.
14-A. 1-12 Greenhouses or plant nurseries on a site of three acres or
more in any district.
14-A. 1-13 Motels, together with related uses, on a site o£ five acres
or more in any district.
14-A. 1-14 The Following uses in ordinanced lake areas in any district:
14-A. 1-14-1 Public and private recreation facilities.
14-A. 1-14-2 ·circus, carniLval, and similar transient amusement
enterprises.
14-A.l-14-3 General farming, but not including the raising of livestock.
14-A. 1-14-4 Parking areas.
14-A. 1-14-5 Outdoor rifle or sk~-shooting ranges.
14-A. 1-14-6 Riding academies and stables when the floor level of the
stables is above flood level.
14.,A. 2 In recommending that a SPECIFIC USE PERMIT for the premises un r
I consideration be granted, .the Planning and Zoning Commission shall determine tha
such uses are harmonious with and adaptable to buildings~ structures, and uses of
abutting p:t;.operty and other property in the vicinity of the premises under considel!'

' 14-A. 3 Every SPECIFIC USE PERMIT granted under these provisions shall
be considered as an amencbnent to the zoning ordinance as applicable to such
property under consideration. In granting such permit~ the City Commission maYi
impose conditions which shall be complied with by the owner or grantee before
certificate of occupancy may be issued by the building inspector for the use of the
building on such property pursuant to such SPECIFIC USE PERMIT; and such con
ditions shall not be construed as conditions precedent to the granting of a SPECI-
FIC USE PERMIT~ or the change in zoning of such property, but shall be construe
as conditions precedent to the granting of the certificate of occupancy.
14-A. 4 No SPECIFIC USE PERMIT shall be granted unless the applicant,
owner and grantee of the SPECIFIC USE PERMIT shall in writing accept and agree
to be bound by and comply with the terms of the SPECIFIC USE PERMIT, in such
form as may be approved and provided by the Director of Planning.
14-A. 5 A building permit shall be applied for and secured within ten months
from the time of granting of the SPECIFIC USE PERMIT provided however, that
the City Commission may authorize an extension of this time upon recommendatioq.

14-A. 6 The Board of Adjustment shall not have jurisdiction to hear, review,
reverse, or modify any decision, determinatio~ or ruling with respect to the
granting, extension~ revocation, modification or any other action taken relating to
such SPECIFIC USE PERMITS.
14-A. 7 When the City Commission authorizes granting of a SPECIFIC USE I
PERMIT, the .zoning map shall be amended according to it.s legend to indicate that .
the affected area has conditions and limited uses.
14-A. 8 Whoever violates the provision of any ordinance pertaining to a
SPECIFIC USE PERMIT or the provisions of a SP.ECIFIC USE PERMIT,.. shall u~o
conviction be fined in any sum not exceeding $200. 00~ and each day of any such
violation shall constitute a separate offense.
14 .. A. 9 Suit for abatement of any violation may be filed in any court of
competent jurisdiction in Lubbock County.
SECTION 2. The City Secretary shall cause the publication of this ordinance
once a week for two consecutive weeks in a newspaper regularly published in the
City of Lubbock and this ordinance shall become effective ten days after its last
publication.
