PROVIDING AN EFFECTIVE DATE FOR THIS ORDINANCE.;
WHEREA~ the electric rate classifications as contained in existing ordinance
of the City of Lubbock are out ... dated ~nd not in step with the increased efficiency
and technical developments ofthe electric utilities located in the City; and

WHEREASa the City Commission finds it is necessary and essential to providEt
additional electric rate classifications to promote the most economic year-round I
usage of the facilities of both the municipal and privately-owned electric service

1 WHEREA~ the City Commission finds that amendment of the existing electric•!
rate ordinances to provide additional classifications and other changes more fully I
set forth in this ordinance is in the public interest and general welfare; NOW
THEREFORE:
II BE IT O~DAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Chapter 11 of the 11Code of Ordinances, City Lubbock,
Texas" entitled 11Electric Rates11, BE and the same is hereby amended to read
hereafter in full as follows, to-wit:
ARTICLE j. ELECTRIC RATES
Sec. 11-1. Rates for service furnished in city, schedules.
The following rates shall be charged for electric service furnished in the
City of Lubbock, according to the classifications herein set out., by all
persons, firms or corporations engaged in furnishing such electric power
service to the public, including electric service furnished by the city1s
electric light system.
RESIDENTIAL
Applicable: To residential customers for lighting and incidental
purposes, including the operation of electric refrigerators, air conditioning
equipment and ranges where u.sed in private residences, individual family
apartments and in private garages.
Rate: For consumption of 26 kwh or less per month, the follow
rate shall apply: ·

Wehn the consumption is more than 26 kwh per month, the
rate stated above shall not apply and all energy used shall be billed
in· accordance with the following rate:

The minimum shall be 7S¢ per month for customers using
26 kwh or less per month. The minimum shall be $1.60 per
month for customers using more than 26 kwh per month.
COMMERCIAL
Applicable: To all commercial places of business, including
11 stores, shops, factories, warehouses, hotels, lodges, churches,
I apartment houses on one meter; garages and filling stations.
Rate: For consumption of 34 kwh or less per month, the following
rate shall apply:

When the consumption is more than 34 kwh per month, the
rate stated above shall not apply, and all energy used shall be
billed in accordance with the following rate:

Character of Service: If metered on secondary side of distribu-
tion transformers, lighting service may be either 120/240 volt, 3
wire single phase, or 120 volt, 2 wire single phase. If polyphase
service is required, lit shall be 3 phase, 240 volts, unless otherwise
specified. W.here primary metering is used, service supplied will be
the primary voltage serving the area, single or polyphase as the case
may require.
Discount: Where primary metering is used, lOo/o will be deducted on
all bills except minimum monthly bills.
The minimum shall be ?Sf per month for customers using 34 kwh
or less per month. The minimum shall be $2.00 per month

SCHOOLS
Applicable: To all institutions whether private, parochial or public.
engaged in providing instruction or education, including elementary
schools, junior high schools, high~ schools. and colleges or universities.
Rate: Shall be the same as established for commercial places of bus-
iness, above; provided however, that where such schools and school
facilities are operated under one authority or entity or as one district,
but at several locations within the city, the consumption at all such loca ...
tions may be added together and the authority, entity or district billed as
if all such consumption was on one meter.
Character of Service: If metered on secondary: side of distribution
transformers, lighting service may be either 120(240 volt, 3 wire single
phase, or 120 volt, 2 wire single phase. If polyphase service is required,
it shall be 3 phase, 240 volts. unless otherwise specified. Where pri-
mary metering is used, service supplied will be primary voltage serving
the area, single or polyphase as the case may require.
Discount: Where primary metering is used, 10% will be deducted
on all bills except minimum monthly bills. If the expansion of facilities
at any one school location, or property adjacent thereto, requires additional
electric services, and if the principle building or buildings at such school
unit is, at the time of installation· of additional meters being served through prima y
metering, and if it should be advantageous tolthe supplying utility and the con-
sumer to meter such new facilities by secondary metering, then, at the option of
the supplying utility. consumption on such secondary metering may be added
to that of the primary meter and the 10ro discount then applied.
The minimum shall be 75~ per month for customers using 34 kwh, or
less, per month. The minimum shall be $2. 00 per month for customers
using more than 34 kwh per month.
INDUSTRIAL UGHTING AND POWER
Demand charge:
$1.00 per month per k.w of demand as measured by demand meter.

Monthly minimum bill shall be the demand charge. The minimum yearly
bill shall not be less than $12. 00 per connected horsepower per contract year.
I£ the total billing hereunder, during such twelve-month period is less than
$12.00 per hp. connected)> the difference shall be added to the bill covering
servic~ for the twelith month of each contract year.
Discount:
None.
Application:
This rate is applicable to ~11 consumers purchasing lighting and
power whose demand exceeds 25 kw, and who execute term contracts
with the supplying utility. Minimum term of contract shall not
be less than one year, subject to all terms and conditions stipulated
in the contract.

II Payment:
At the beginning of each calendar year or prior to the date service
is connected, the customer shall deposit with the supplying utility
j1 the sum of $4.50 per horsepower of motor or motors up to 30 hp.
and an additional $3.00 per horsepower above 30 hp., which deposit
1 constitutes the minimum horsepower charge. Statements will be
1 rendered at regular meter reading dates each month, the amount
of such statements to be applied against the deposit made until
1 such deposit shall be absorbed, which absorption shall be not
later than December 31st. Statements for additional current used
after deposit is absorbed shall then become payable ten days
after the bill for such service is rendered.
ljA.pplication: I This rate is applicable for irrigation power service where
motor installation is 20 hp .. or more.· Service furnished only under
contract. Less than 20 hp. will be charged commercial rates.
ELECTRIC HEATING SERVICE·
Applicable: To residential and commercial customers for water heating
nd/or space heating service, including resistance heating, radiant
heating and heat pumps, when all heating servic~ is supplied at one. point
!.of delivery and measured through one kilowatthour meter.
Space Heating Rate: Winter Months: All kwh used per month@
one and 1/4 cents per kwh, except that the first 300 kwh used per month
·ill be billed @I. 0~ per kwh when custome.r has an electric water heater
nstalled and in use.
Summer Months: All kwh used per month shall be combined
and billed under the applicable residential or commercial rate~
except that the first 300 kwh used per month through the heating
meter will be billed@ 1. 0 cents· per kwh when the customer has
an electric water heater installed and in use.,
Winter Months: The billing months of November to April,
inclusive.
Summer Months: May to October inclusive•
Conditions and Regulations: Water heating equipment served on
this rate shall be of insulated storage type bearing the approval of
the Underwriter's Laboratories, Inc.. Space heating equipment~
and the installation of the equipment shall be subject to the
approval of the supplying utility. To be eligible for the one and
1/4 cent space heating rate, a customer must have permanently
installed and in regular use space heating equipment having a
total connected load of not less than 5 kilowatts.
Character of Service: The voltage and characteristics of equip•
ment applied shall meet requirements of the supplying utility.
ELECTRIC WATER HEATING SERVICE
Applicable: To water heating service in homes or commercial
establishments. Service under this rate is subject to the conditions
k nd regulations governing water heating as stated below.
Rate: All kwh per month @ 1¢ per kwh.
Conditions and Regulations:
(1) Water heating equipment served on this rate shall be of
insu~ted storage type bearing the approval of the Under-
. -·~wdter's Laboratories, Inc., and shall have a demand of not
greater than 4. 5 kilowatts individual capacity.
(2) Service will be supplied through a separate circuit to
which no equipment except the water heater will be con-
-ne·cted. A separate meter will be furnished by the supply•
ing utility.
ec., 11-Z All other consumers to pay commercial rates
All users or customers of all electric power utilities within the
ity to whom the rates set forth in Sec. 11·1 are not made specifically
pplicable, shall be charged commercial rates, except electrical
rervice furnished between public electrical energy suppliers which
rates shall be negotiated.
I ec. 11-3 New rates not to affect existing contracts.
The rates established in Sec. ll-1 shall in no way be construed
o affect rates being charged by virtue of written contracts executed
nd in effect as of midnight, May 31, 1959; provided however, that
pon the expiration by their own terms of such contracts, all further
ontracts shall be made in conformity with the rates established in
ec. 11-1.
ARTICLE ll. MUNICIPAL ELECTRIC
POWER SYSTEM
Sec. 11-4 Same -Payment
The rate$ and charges fixed and prescribed by the preceding
sections shall become due and payable ten days after the bill for
such charges is rendered. Such bills shall be paid by the users of
such service of the electric light system of the city to the water and
light office at City Hall ..
Sec. ll-5 Same -Discontinuance of service for failure to pay
In the event any user or customer of the city's electric light
system does not pay matured rates and charges within twenty days
from the date the same become due and payable, it is hereby made
the duty of the Director of Utilities, Sal~s and Collections to dis-
connect the electric service. Whenever the amount past due and
delinquent is paid by such user or customer, such service may be
resumed, but there shall be charged and collected a reconnection
charge of one dollar. Such service shall also be disconnected when
a consumer fails to pay for water service rendered by the city.
Sec. 11-6 Same .. City must pay
No free electric service shall be allowed and, to the extent that
the city or any of its agencies or instrumentalities avail themselves
of the service and facilities provided by its electric light and power
system,. they shall pay the rates and charges prescribed by this
Chapter and total consumption computed and charged as if served
through one meter. ·
SECTION 2. THAT the City Secretary is hereby authorized and directed to
cause publication of this Ordinance once a week for two consecutive weeks in the
official publication of the City of Lubbock.
SECTION 3. This Ordinance shall become effective as of Midnight of the 31st
day of May, 1959.. ·
