ORDINANCE .NO. 27$S
AN ORDINANCE AUTHORIZING THe; ALTElUNG AND CHANGING OF
THE PRIMA FACIE SPEED LIMIT FROM 30 MILES PER HOUR TO 45
MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS:
On the South side of East 4~ Street (State FM 40) beginring at
the east side of the intersection of the Idalou Road (U.S. 62)
and extending eas t .2 mil~.
AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY;
PROVIDING FOR PUBLICATION;-AND DECLARING AN EMERGENCY; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the governing body, as authorized by Article 827a,
Sec. 8, Vernon's Annotated Penel Code, finds t hat certain prima facie
speed limits on certain highways are dif.fcrent fr>m what is reasonable
or safe and should be altered ar.d t he immedia te preservation of public
health and safety r equires immediate alteration of said prima facie
speed limits as hereafter set forth, which crea tes an emerge1cy;
NOW THEHEFORE,
BE IT ORDAINED BY THE CITY COMl'USSION OF THE CITY OF LUBBOCK :
SECTION 1. The prima facie speed limit est..~.blis!:led by Arti-
cle 827a1 Section 8, Subsection 1 (b), Vernon's Annotated Penal Code,
i~ altered and ch~nged for all vehicles to '~ miles per ho ur on
the following designated highways or stre~ts ln the corporate limits
of the City of Lubbock, Lubbock County, Texas,. to-wit:
On the South side of East 4~ Street (State ni 40) beginning at
the east ade of the intersection of the Idalou Road (U.S. 62)
and extending east .2 mile.
SECTION 2. The City Manager is authorized and directed to
cause the placing of signs ·so as to clearly define the l imits of the
prima facie areas set out in this ordinance.
S3CTION 3. Any person, firm or corporation violating the
prima facie speed limit established b this Ordinanc e s hall upon con-
viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00 )
and for subsequent violations withi~ one yea r thereafter shall be pro-
secuted as prescribed for such violations by Section 15 of Article
827a, Vernon's At notated Penal Code.
SECTION 4. The City s~cre ta ry is authorized and directed t o
cause the publication of the descriptive caption of this Or dinance t o-
g ether wi th the penalty provisio~ as ~n alterna tive method of publi-
cation as provided by lawo
SECTION 5. The f a ct that public neces&ity and convenience
requires that this Ordinance be passed as an emergency me ~sure for

reasons set f orth in the preamble hereof, the rule requ~r~ng that no
Ordinance shall be finally passed on the day of its introduction be
suspended, and this Ordinance is declared to be an emergency meas ure
to take effect f rom and after its passage.
