ORDINANCE NO. 2792
AN ORDINANCE AUTHORIZING TEE ALTERING AND CHANGING OF
THE PRIMA FACIE SPEED LIMIT FROM 30 MILES PER HOUR TO 60
MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS:
On both the North a nd South sides of 4~ Street (State FM 40)
beginning at t he East side of t he intersecti on of Jufty Avenue
and extending East to the City limits.
AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY;
PROVIDING FOR PUBLICATION; AND DECLARING AN ~XRGENCY; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS O'RDIN.ANCE.
WP~REAS, the governing body, au authorized by Article 827a,
Sec. 8, Vernon's Annotated Penel Code, fin~s th3t certain prima facie
speed limits on certain highways are different fr>m what is reasonable
or safe and should be altered a~1 t he immediate preservation of public
health and safety requires immedia te alteration of said prima facie
speed limits as hereafter set forth, which creates an emerg.e; cy;
NOW THEHEFORE,
BE IT ORDAINED BY THE CITY COMtHSSI'JN OF THE CITY OF LUBBOCK:
SECTION 1. The prima facie speed limit established by Arti-
cle 82?a, Section 8, Subsection l (b), Vernon's Annotated Penal Code,
i~ <ered and ch~nged for all vehicles to 60 miles per hour on
the following designated high~ays or stre,ts ln the corporate limits
of the City of Lubbock, Lubbock County, Texas, to-wit:
On both the North and South sides of 4~ Street (State FM 40)
beginning at the East side of the Intersection of Jui~ Avenue
and extending East to the City limits.
SECTION 2. The City1Manager is authorized and directed to
cause the placing of signs so as ~o 'clearly define tho limits of the
prima facie aTe as set out in this ordinance'·
' S~CTION 3. Any person, firm or corporat~on violating the
prima facie speed limit established b this Ordirran~e shall ~pon con-
viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00)
and for subseq_uent violations withir. one year t hereafter shall b.e pro-
secuted as prescribed for such violations by Section 15 of Article
827a, Vernon's At•notated Penal Code.
SECTION 4. The City Secreta ry is authorized and directed to
cause the publication of the descriptive caption of this Ordinance to-
gether wi th the penalty provisio~ as an alterna tive method of publi-
cation as provided by law.
SECTION 5. The fact tha t public necessity and convenience
requires that this Ordinance be pa ssed as a n emergency me~su~e for
r· ' reasons set forth in the preamble hereof. the rule r equiring that no
Ordinance shall be finally passed on the day of its introduction be
suspended, and this Ordinance is declared to be an emergency meas ure
to take effect from and after its passage.
