AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF
THE PRIMA FACIE SPEED LIMIT FROM 30 MILES PER HOUR TO 55
MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS:
On both the North and South sides of 4~ Street (STATE FM 40)
beginning .2 mile East of the intersection of the Idalou Road
(U.S. 62) and extending to the East side of the intersection
of Juiy Avenue.
AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY;
PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY; AND PROVIDING
FOR THE EFFECTIVE DATE OF THIS ORDINANCE.
W~~REAS, the governing body, as authorized by Article 827a,
Sec. 8, Vernon's Annotated Fencl Code, finds that certa1.n prima facie
speed limits on certain highways arc different fr)m what is reasonable
or safe and should be altered ar-1 the immediate preservation of public
health and safety requires immediate alteration of said prima facie
speed limits as hereafter set forth, which creates an emergePcy;
NOW THEHEFORE,
BE IT ORDAINED BY THE CITY COMHISSI0N OF THE CITY OF LUBBOCK:
SECTION 1. The prima facie speed limit es~ablished by Artl-
cle 827u, Section 8, Subsection l (b), Vernon's Annotated Penal Code,
is altered and changed for all vehicles to 55 miles per hour on
the following designated highways or stre ts ln the corporate limits
of the City of Lubbock , Lubbock County, Texas, to-wit:
On both the North side and South side of 4~ Street (State FM 40)
beginning .2 mile East of the intersection of the Idalou Road
(U.S. 62) and extending to the East side of t he intersection
of Jul.~ Avenue.
SECTION 2. The City Manager is authorized and directed to
cause the placing of signs so as to clearly define the limits of the
prima facie areas set out in this ordinance.
SSCTION 3. Any person, firm or corporation violating the
prima facie speed limit established b. this Ordinance shall upon con-
viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00)
and for subsequent violations within one year thereafter shall be pro-
secuted as prescribed for such violations by Secti on 15 of Article
827a, Vernon's Ar notated Penal Code.
SECTION 4. The City Secr~tR ry is authorized and directed to
cause the publication of the descriptive caption of this Ordinance to-
gether with the penalty provision as a n alternative method of publi-
cation as provided by law.
SECTION 5. The f a ct tha t public necessity and convenience
requires that this Ordinance be pa ssed as an emergency me~sur·e for
reasons set f orth in the preamble hereof, the rule r equ~r~ng that no
Ordinance shall be finally passed on the day of its i ntroduction be
suspended, and this Ordinance is declared to be an emergency measure
to take effect from and after its pas sage.
