AN ORDINANCE AU THORIZING TF~ ALTERING AND CHANGING OF
THE PRH1A FACIE SPEED LIHIT FROM 30 MILES PER HOUR TO 45
MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBE~D-AS~--F~O~LLOWS:
On the North side of East 4~ Street(State FM 40) beginning at
the East side of the Intersection of the Idalou Road (U.S. 62)
and extending East .2 mile.
AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY;
PROVIDING FOR PUBLICATION; AND DECLARI~G AN EMERGENCY; AND PROVIDING
FOR THE EFFECTIVE DATE OF T~IS ORDINANCE.
WHEREAS, the governins body, as c..uthorized by Article 827a,
Sec. 8, Vernon's Annotated Penel Code, flnjs ~hut certain prima facie

NOW TffEREFORE,
BE IT ORDAIN~D BY THE CITY C0~1ISSI0N OF TPE CITY OF LUDBOCK:
SECTION 1. The prima facie speed limit esi,<;.ulis!:J.ed by Arti-
cle 827~, Section 8, Subs ~c tion 1 (b), Verr.on's Annotated Penal Code,
is ~ltered and ch8 nged for all vehicles to 45 miles per hour on
t he following designated high~ays or stre ts in t he corporate limits
of the City of Lubbock, Luobock County, Texas, to-wit:
On the North side of East 4~ Street (Sta te FM 40) beginning at
the East side of the Intersectlon of the Idalou Road (U.S. 62)
and extending East .2 mile.
SECTION 2. The City Manager i s authorized an,l directed t o
cause the placing of signs so as to cle ~rly define the limits of the
prima facie areas set out in this ordinance.
SSCTION 3. Any person, firm ar corporation viol~ting the
prima facie speed limit established b this Ordinan ··e shall upon con-
viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00)
and for subsequent violations withic one year thereaiter scall be pro-
secuted as prescribed for such violations by Section 15 of Article
827a, Vernon's Atnota ted Penal Code.
SECTION 4. The Ci·i;y Secr&tc:!ry is authorized and directed t J
cause the publication of t h e descriptive c&ption of this Ordi&ance to-
gether wi th the penalty provisio~ as an altern&tive method of publi-
cation as provided by law.
SECTION 5. The f~ct that public neces&ity and convenience
requires that this Ordinance be passed as an emergency ;ne<jsure for

reasons set forth in the preamble hereof, the rule re qu~r~ng that no
Ordinance shall be finally passed on the day of its introduction be
suspended, and this Ordinance is declared to be an emergency measure
to take effect from and after its passage.
AND IT IS SO ORDERED.
