J )?~THE PRU1A FACIE SPEED LHHT FROM 30 MILES PER HOUR TO 50 MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS: On the North side and South side of 4~ Street (State FM 2255) beginning at the West side of the intersection of Elgin Avenue and extending West for approximately .2mile. AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY; .PROVIDING FOR PUBLICATION;" AND DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body, as authorized by Article 827a, Sec. 8, Vernon's Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered ar.d the immediate preservation of public health and safety r equires immediate alteration of said prima facie speed limits as hereafter set forth, which crea tes an emerge ~cy; NOW THEREFORE, BE IT ORDAINED BY THE CITY C0~1ISSI0N OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit establish ed by Arti- cle 827a, Section 8, Subsection 1 (b), Vernon's Annotated ~enal Code, is altered and changed for all vehicles to 50 miles per hour on the following designated highways or stree ts in the corporate limits of the City of Lubbock, Lubbock County, Texas, to-wit: On the North side and South side of 4~ Street (State FM 2255) beginni ng at the West side of the intersection of Elgin Avenue and extending West for approximately .2 mile. SECTION 2. The City Manager is authorized and uirected to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this ordinance. SECTION 3. Any person, firm or corporation violating the prima facie speed limit established b .. this Ordinance shall upon con- viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00) and for subsequent violations within one year thereafter shall be pro- secuted as prescribed for such vi olations by Section 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 4. The City Secre t a ry is authorized and directed to cause the publication of the descriptive caption of this Ordinance to- gether with the penalty provision as a n alternative method of publi- cation as provided by law. SECTION 5· The f a ct tha t public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set f orth in the preamble hereof, the rule r Gqu1r1ng t~at no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect from and after its pas sage.
