HomeMy WebLinkAboutOrdinance - 2768-1959 - Changing Prima Facie 30 To 45 MPH - 04/23/1959(F0~1 N04 LAD~,<7) ou-;2.3-\ y '::H_ ORDiNANCE NO. 2768 AN ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA FACIE SPEED LIMIT FROM 30 MILES PER HOUR TO . 45 MILES PER HOUR ON THAT PORTION OF THE STREETS DESCRIBED AS FOLLOWS: Ou the North side and South side of 4~ ~treet (State FH 2255) beginning at the Panhandle and Santa Fe Railroad crossing and extending West to the West side of the intersect ·-On of Elgin Avenue. AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION;' AND DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE. WF~REAS, the governing body, as authorized by Article 827a, Seco 8, Vernon's. Annotated Penal Code, finds that certain prima facie speed limits on certain highways are different fr0m what is reasonable or safe and should be altered a r.d the immedinte preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth, which creates an emerg.e~ cy; NOW THEREFORE, BE IT ORDAINED BY THE CITY C0~1ISSI0N OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Arti- cle 827a, Section 8, Subsection 1 (b), Vernon's Annotated Penal Code, is altered and changed for all vehicles to 45 miles per hour on the following designated highways or stre.ts in the corporate limit5 of the City of Lubbock, Lubbock County, Texas, to-wit: On the North side and South side of 4~ Street (State FM 2255) beginning at the Panhandle and Santa Fe Railroad crossing and extending Weat to the ~lest side of the intersection of Elgin Avenue. SECTION 2. The City Manager is authorized anu directed to cause the placing of signs so as to cleurly define the limits of the prima facie areas set out in this ord.inance. S3CTION 3. Any person, firm or corporation violating the prima facie speed limit established b · this Ordinance shall upon con- viction be fined in any sum not to exceed TWO HUNDRED DOLLARS($200.00) and for subsequent violations within one year thereafter shall be pro- secuted as prescribed for such violations by Section 15 of Article 827a, Vernon's Annotated Penal Code. SECTION 4. The City Secretary is authorized and directed to eause the publication of the descriptive caption of this Ordinance to- gether with the penalty provision as an alternative method of publi- cation as provided by lawo SECTION 5· The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for -- reascns set forth in the preamble hereof, the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect from and after its passage.
