AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AN HE
OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE T:r,IE FOLLOWING
CHANGE: ZONE CASE NO. 758 : CHANGE LOTS 2. THROUGH 12. INCLUSIVE
AND LOTS 2.4 THROUGH 31INCLUSIVE, BLOCK 2, IUGHLAND PLACE ADDITI
(BEING A PORTION OF THE PROPERTY CONSIDERED BY THIS CASE) FROM
11R-2.tt TO A "C-211 ZONING DISTRICT • SUBJECT TO THE FOLLOWING CONDI-
TIONS: (1) THAT THE PROPERTY BE DEVELOPED IN GENERAL CONFORMA CJ
WITH THE PLAN ON FILE IN ZONE CASE NO. 758 IN THE OFFICE OF THE
SECRETARY OF THE PLANNING AND ZONING COMMISSION. (2} THAT A
SOUD SEVEN FOOT VISUAL SCREENING WALL OR FENCE OF MASONRY CON
STR UCTION OR THE EQUIVALENT BE PLACED ALONG THE SOUTH SIDE OF
THE PROPERTY ADJACENT TO THE NORTH RIGHT-OF-WAY UNE OF 35TH
STREETt ALONG THE NORTH LINES OF LOTS 23 AND 13, AND ALONG THE
WEST LINE OF LOT 32, ALL IN BLOCK 2, SAID fnGHlAND PLACE ADDITION.
THE WALL OR FENCE SHALL BE REDUCED IN HEIGH!' AT EACH·ENTRANCE
AND EXIT, TO PROVIDE ADEQUATE SIGHT DISTANCE. {3} THAT THE OWNE
AND/OR DEVELOPERS SHALL MAKE APPUCATION FOR AND SECDR1E A
BUILDING PERJMIT WITHIN TEN MONTHS AFTER THE DATE OF FINAL PASS-
AGE OF TIDS ORDINANCE.
WHEREAS, a proposed change in zoning districts has been duly presented to
the Zoning and Planning Commissionfor its recommendation, which was receiv·ed
by the City Commission and after due consideration and all interested parties at
the public hearing were given an opportunity to speak for or against said proposal,
the City Commission finds that making said zone c.hange as hereinafter modified,
revised and set out will be in the public interest; and,
WHEREAS, all conditions precedent required by law for a valid amendment to
the Zoning Ord_inance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of O~dinance No. 1695 as well as notices
provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953,
and notice was duly published in the Lubbock Morning Avalanche more than fifteen
(15) da:ys p rior to the date of the public hearing before the City Commission on su
proposed amendment, and the public hearing according to said notice was duly hel
in the City Commission Room on the first floor of the City Hall, Lubbock, Texas,
at which time persons appeared in support of the proposal; and, after said hearing

it was by the City Commission determined that it would be in the public interest,
due to changed conditions, that the Zoning Ordinance and the Zoning Map be amend .d
in the manner hereinafter set forth in the body of this Ordinance and this Ordinanc
having been introduced in final written form prior to first reading hereof; NOW,
THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK;
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and
the same are hereby amended as follows, to-v.:it:
ZONE CASE NO. 758
Change Lots 2 through 12 inclusive and Lots 24 through 31
inclusive, Block 2, Highland Place Addition (Being a portion
of the property considered by this case) from an 11R-211 to a
11C-211 zoning district, s.ubject to the following conditions:
(1) That the property be developed in general conformance
with the plan on file in Zone Case File No. 758 in the office
of the Secretary of the Planning and Zoning-Commission.

{2) Tha.t a solid seven foot visual scre!!ning wall or fence
of masonry construction or the equivalent be placed along
the South side of the property adjacent to the North right-
of-way line of 35th Sreet, along the North lines of Lots 23
and 13, and along the West line of Lot 32, all in Block 2,
said Highland Place Addition. The wall or fence shall be
reduced in height at each entrance and exit, to provide
adequate sight distance. ·
(3) That the owners and/or developers shall made applica-
tion for and secure a building permit within ten months after
the date of final passage of this ordinance.
SECTION 2 ; THAT from and after passage and effective date of this Ordinan e,
said lots, tracts and parcels O.f land described in Section l hereof shall be change
to the zoning district indicated and the Official Map is amended in accordance
herewith.
AND IT IS SO ORDERED
