AN ORDINANCE AMENDING SUBSECTION 20. 5-l OF THE LUBBOCK
CITY CODE SO AS TO REVISE ZONING REGUlATIONS WITH RESPECT TO
SUBSEQUENT APPLICATIONS' FOR A PROPOSED AMENDMENT, SUPPLE-
MENT, CHANGE OR MODIFICATIONS IN THE BOUNDARIES OF ANY ZONiNG
DISTRICT AFTER THE ZONING AND PlANNING COMMISSION HAS DISAPPROV D
THE ORIGINAL APPLICATION; PRESCRIBING A PENALTY; AND PROVIDING
FOR PUBLICATION AND THE EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the matter of revising zoning regulations with respect to sub-
sequent applications for a proposed amendment, supplement, change or modifica-
tion in the boundaries of any zoning district after the original application has been
disapproved by the Zoning and Planning Commission, has been referred to the
Zoning and Planning Commission for its recommendation and report, which reco
mendation and report, haS:. be~n receiv.ed by the City Commission, and the City
Commission finds it would be in the public interest, safety, health and welfare to
amend the Zoning Ordinance No. 1695 in accordance with said recommendation
and report; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT Subsection 20.5-1 of the existing Lubbock City Code an
·the revised Lubbock City Code (which becomes effective April 27, 1959) is hereby
amended to read hereafter as follows: Subsection 20. 5-l of Zoning Ordinance No .
. !695 (an ·appendix to said Code).
.... 1120. 5-1 In the event that the Zoning and Planning Commission
has recommended against a proposed amendment, supplement,
change or modification in the boundaries of any zoning district,
and such amendment or change has not been approved by the City
Commission as ·provided in Subsection 20.4-3 of Ordinance No.
1695, such proposed amendment, supplement, change or mod-
ification in the boundaries of such zoning district shall neither
be submitted nor considered for recommendation by the Zoning
and Planning Commission prior to the expiration of twelve (12)
months from the date of the order or decision by the Zoning and
Planning Commission recommending against such zone change,
unless conditions pertaining to p roperty a:nsidered in the
original application and/or p roperty in the area have, in the "'
opinion of the Zoning and Planning Commission changed to such
an extent as to~ justify a subsequent application prior to the
expiration of twelve (12) months from the date of the original
order or decision of the Zoning and Planning Commission. 11
SECTION 2. Any person, firm, or corporation violating any provision of
this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUN-
DRED ($200. 00) DOLLARS.
SECTION 3. The City Secretary is authorized and directed to cause the
publication of this ordinance once a week for two consecutive weeks in a newspape
regularly published in the City of Lubbock and this Ordinance shall become effecti e
ten days after its last publication.
