OR SUBSTANTIALLY REPAIRED BETWEEN SUCH BUILDING LINES; REQUIRING EXISTING STRUCTURES ON OR BETWEEN THE BUILDING LINES HEREIN ESTABLISHED TO CONFORM TO SUCH BUILDING LINES WITIDN FIVE (5) YEARS; DEFINING BUILDING LINE AND PROVIDING THAT SET BACK REQUIREMENTS UNDER THE CITY'S ZON- ING ORDINANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE BUILDING LINES HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTI- LITY EXTENSlONS AND PUBLIC IMPROVEMENTS; PROVIDING A SAVINGS CLAUSE. WHEREAS, Article ll05a, Revised Civil Statutes of Texas provides for the establishment of building lines on any part or side of any street in the City of Lubbock.,· said city having a population of more than 15, 000 per sons; and, WHEREAS. the City Commission finds that public c onvenience., safety and necessity in the City of Lubbock require that building lines or rights-of-way lines be established on the North and South sides of 50th Street at the place and loc ation more particularly described by metes and bounds in the body of this ordinance, to prevent repair and replacement of structures and trees in the area between the building lines as established, such areas being required in connection with widen- ing.~ opening and improving that part of 50th Street as hereinafter described; and, WHEREAS, the widening and improving of 50th Street and the establishment I of such building lines are necessary and will ultimately provide streets of desir- able and adequate width which will aid and relieve heavy traffic in congested area in acc-ordance with the cityts comprehensive plan,. and the city1s planning comm- ission has recommended such plan. The City Commission further finds that such establishment of building lines at this time will promote economy; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a building line is hereby established on the North and South sides of 50th Street at the place and location as hereinafter described and within the corporate boundaries of the City of Lubbock, Lubbock County, Texas,. which building lines are more particularly described as follQws, to-wit: North side of 50th Street from Avenue A to Slide Road BEGINNING at a point 50 feet North of the Southeast corner of Survey 8~ Block B, Lubbock County., Texasi THENCE Southwesterly a distance of 421. 07 feet to an angle point~ said angle point being 42.0 feet West and 2.0 feet North of the Southeast corner of Survey 8., Block B; ,.. THENCE West along a line parallel to and ZO feet North of the South line of Survey 81 Block B~ a distance of 56Z. 5 feet; THENCE Northwesterly a distance of 368. Z7 feet to a point which is 1349. l feet West and 55 feet North of the Southeast corner of Survey 8,. THAT no building or other structure shall hereafter be erected re-erected or substantially repaired and no new structure or parts thereof shall be erected on that part of the street or land herein designated within said building lines hereinabove described. SECTION 3. THAT all structures on or between the building lines establi she by this Ordinance or extending in whole or in part within such building lines are hereby required to conform to the new building lines established in Section One I (l) of this Ordinance within five (5) years from the effective date of this ordinanc • SECTION 4. THAT the term 11 Building Line11 as herein used shall be con- strued to mean "street right-of-way line11, and the setback requirements under the Cityts Zoning Ordinance and all amendments thereto shall apply in addition to the right-of-way lines or building lines herein established~ it being the intent and purpose of this Ordinance to preserv e all land within the building lines herein established for ultimate street purposes. SE.CTION 5 . The provisions of this Ordinance shall not apply to any officer~ agent~ employee or other pe·rson duly authorized by the State of Texas and/or the City of Lubbock when performing any employment pursuant to the widening, straightening or extension of the street and/ or the right-of-way contemplated by this Ordinance or authorized utility extensions Within the right-of-way herein described. SECTION 6. If any section, paragraph, subdivision, clause, phrase or pro- vision of this Ordinance shall be j udged invalid or held unconstitltional, the same shall not affect the validity of the remainder of this Ordinance as a whole or any part of provisions thereof other than the part so decided to be invalid or uncon- stitutional. · SECTION 7 . Any existing building lines which are in conflict with the build- ing lines established by this ordinance are hereby repealed to the extent of such conflict.
