HomeMy WebLinkAboutOrdinance - 2740-1959 - Repealed By Ordinince 4311 - 04/26/1959k '. ~­/~ Repealed by Ordinance No. 4311 -· ORDINANCE NO. 2740 04-09 .. l.959~---- AN ORDINANCE ESTABLISIDNG BUILDING LINES ON THE NORTH AND SOUTH SIDES OF 50TH STREET AT THE PLACE AND LOCATION AS MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF TIDS ORDINANCE; PROVIDING THAT NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTED, RE-ERECTED• OR SUBSTANTIALLY REPAIRED BETWEEN SUCH BUILDING LINES; REQUIRING EXISTING STRUCTURES ON 0 BETWEEN THE BUILDING LINES HEREIN ESTABLISHED TO CONFORM TO SUCH BUILDING LINES WITIDN FIVE (5) YEARS; DEFINING BUILDING LINE AND PROVIDING THAT SET BACK REQUIREMENTS UNDER THE CITY'S ZONING ORDINANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE BUILDING LINES HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTILITY EXTENSIONS AND PUBLIC IMPROVEMENTS• PROVIDING A SAVINGS CLAUSE. WHEREA~ Article 1105a, Revised Civ il Statutes of Texas provides for the establisJunent of building lines on any part or side of any street in the City of Lubbock,. said city having a population of more than 15, 000 persons; and, WHEREAS, the City Commission finds that public convenience~ safety and necessity in the City of Lubbock require that building lines or rights-of-way line be e stabli ehed on the North and South sides 50th Street at the place and location more particularly described .bY metes and bounds in the body of this ordinance:t to prevent repair and replacement of structures and trees in the area between thei building lines as established, such areas being required in connection with wide- ning, opening and improving that part of 50th Street as hereinafter describe<4 an , WHEREAS,. the widening and improving of 50th Street and the establishment of such building lines are necessary and will ultimately provide streets of desir- able and adequate width which will aid an~ relieve heavy traffic in congested area in accordance with the city's comprehensive plan, and the city's planning commi- ssion has recommended such plan. The City Commission further finds that such establishment of building lines at this time will promote economy; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a building line is hereby established on the North and South sides of 50th Street at the place and location as hereinafter described and w ithin the corporate boundaries of the City of Lubbock, Lubbock County,. Texas, which building lines are more particularly d e s c ribed as follows, to-wit: North side of 50th Street between Avenue A and Southeast Drive BEGINNING at a point which is 55 feet North of the Southwest corner of Survey 6, Block B, Lubbock County, Texas; THENCE East along a line parallel to and 55 feet North of the South line of Survey 6, Block B, a distance of 333. 9 feet; THENCE South 5 feet to a point 50 feet No.tfl of the South Line of Survey 6 _ock_lh_ _ / '~ r THENCE East along a line parallel to and 50 feet North of the South line of Survey 6, Block B1 a distance of 2.2.78 feet, more or less, to a point,. said point being 2.8 feet West of the East Line of the Southwest one-quarter of Survey'.61 Block B; THENCE Northeasterly 300. 17 feet to a point, said point being 2.72. feet East and 60 feet North of the Southwest corner of the Southeast one- quarter of Survey 6, Block B; I THENCE East along a line parallel to and 6g feet North of the South Line of Survey 6, Block B, a distance of 1768 feet more or less, to a point, said point being 600 feet West and 60 feet North of the Southeast corner of Survey 6, Block B; THENCE Southeasterly a distance of 600.08 feet to a point which is 50 feet North of the Southeast corner of Survey 6., Block B; THENCE East along a line parallel to and 50 feet North of the Souttff:te · v Survey 4, Block B, Lubbock Countyt..o1exas:J a distance of 2984 feet more or less to a point in the East line of7I~,. Block 4, Clutter Addition to the City of Lubbock, Lubbock County, Texas, said point also being 50 feet North of the South Line of Survey 4., Block B; THENCE Northeasterly a distance of 396.. 13 feet to a point in the East Line of Lot }. 9, Block 4, Clutter Addition, said point being 60 feet North of the South Line of Survey 4, Block B; THENCE East along a line parallel to and 60 feet North of the South Line of Survey 4, Block B,. a distance of lOZS feet more or less, to a point in the West right -of-way of the (Old Slaton Highway) Southeast Drive, said point being 60 feet North of the South Line of Survey 4, Block B) South side of 50th Street between Avenue A and Southeast Driv e BEGINNING at a point 60 feet South of the Northwest corner of Survey 1, Block E, Lubbock County, Texas; THENCE East along a line parallel to and 60 feet South of the North Line of Survey 1, Block E1 a distance of 2.612 feet, more or less~ to a point, said point being 2.8 feet West and 60 feet South of the Northeast corner of the Northwest one-quarter of Survey 1~ Block E; THENCE Northeasterly a distance of 300. 17 feet to a point, said point being 2.72. feet East and 50 feet South of the Northwest corner of the Northeast one-quarter of Survey 1,. Block E; THENCE East along a line parallel to and 50 feet South of the North line of Survey 1, Block E, a distance of 1768 feet, more or less,_ to a point, said point being 600 feet West and 50 feet So~th o£ the Northeast corner of Survey 1, Block E; ., THENCE Southwesterly a distance of 60·0. 08 feet to a point which is 60 feet South of the Northeast corner of Survey la Block E; THENCE East along a line parallel to and 60 feet South of the North line of Sury,eys 23, Block E, and Survey z~ BlockS, Lubbock County, Texas; a distance of 2984 feet, more or less to a point.., said point being in the Southerly proj~ction of the East line of Lot 171 Block 41 Clutter Addition and 60 feet South of the North Line of Survey Z, BlockS; THENCE Northeasterly a distance of 396. 13 feet to a point, said point being in the Southerly extension of the East line of Lot l9ll' Block 4, Clutter Addition and 50 feet South of the North Line of Survey Zt. Block s~ THENCE East along a line parallel to and 50 feet South o£ the North Line of Survey Z, Block S, a distance of 1117 feet, more or less to a point in the West right .. of-way line of the (Old Slaton Highway) South- east Drive, said point being 50 feet South of the North Line o£ Survey Z, Blocks. SECTION Z. THAT no building or other structure shall hereafter be erected re-erected or substantially repaired and no new structure or parts thereof shall be erected on that part o£ the street or land herein designated within said buildin~ lines hereinabove described. SECTION 3. THAT all structures on or between the building lines e stabli she~ by this Ordinance or extending in whole or in part within such building lines are hereby required to conform to the new building lines established in Section One (1) of this Ordinance within five (5) years from the effective date of this ordinanc~ • SECTION 4. THAT the term 11Building Line11 as herein used shall be .con- strued to mean ''street right-of-way line111 and the setback requirements under the City's Zoning Ordinance and all amendments thereto shall apply in addition to the right-of-way lines or building lines herein established, it being the intent and purpose of this Ordinance to preserve all land within the building lines herein established for ultimate street purposes. SECTION 5. The provisions of this Ordinance shall not apply to any officer., agent, employee or other person duly authorized by the State of Texas and/or the City of Lubbock when performing any employment pursuant to the widening, straightening or extension of the street and/ or the right-of-way contemplated by this Ordinance or authorized utility extensions within the right-of-way herein described. SEC.TION 6. If any section.., paragraph~ subdivisionot clause~ phrase or provision of this Ordinance shall be judged invalid or held unconstitutional.., the same shall not affect the validity of the remainder of this Ordinance as a whole o any part of provisions thereof other than the part.so decided to be invalid or un- constitutional.
