AN ORDINANCE AMENDING SUBDIVISIONS 29-3B(2) AND 29-6A(l) OF B01'
THE EXISTING AND REVISED LUBBOCK CITY CODE SO AS TO INCREASE TF ~
PERIOD OF TIME ALLOWED FOR THE SUBMISSION OF FINAL PLATS FROM
SIXTY TO ONE HUNDRED EIGHTY DAYS; PRESCRIBING A PENALTY; AND
PROVIDING FOR PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the Planning and Zoning Commission of the City of Lubbock has
recommended that the period of time allowed for the submission of final plats be
increased from sixty to one hundred eighty days; and1
WHEREAS,. the City Commission finds it would be expedient and in the intere t
of the public safety~ health, and welfare to amend the subdivision Regulations of
the City of Lubbock in compliance with said recommendation; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1.
(A}THAT Subdivision 29-3B(2) of the existing Lubbock City Code and the
.revised Lubbock City Code (which becomes effective April 271 1959) is hereby
amended to read hereafter as follows:
1129 .. 3B(2) Two copies of the final plat, together with a reproducible
sepia and supplementary materials required for approval shall be
prepared as specified in section 29-6 of this Code, and shall be
submitted to the planning commission within one hnndred eighty days
after approval of the preliminary plat; otherwise, such approval shall
become null and void, unless an extension of time is applied for and
" granted by the planning commission. 11
(B) THAT the first sentence of Subdivision 29-6A(l) of the existing Lubbock
City Code and the revised Lubbock City Code (which becomes effective April 271
1959) is hereby amended to read hereafter as follows:
1129-6A(l) Upon receiving conditional approval as provided in Section
29-5 of this Code, the owner of the tract proposed for subdivision
shall_, within one hundred eighty days, have prepared and submitted a
final plat to the planning commission. 11
SECTION 2. Any person, firm, or Corporation violating any provision oft
ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRE
AND N0/100 ($20Q. 00) DOLLARS.
SECTION 3. The City Secretary shall cause this ordinance to be published
once a week for two consecutive weeks in a newspaper regularly published in the
City of Lubbock and this ordinance shall become effective ten days after its last
publication.
