TO AUTHORIZE SUMMONING OF CORPORATION COURT JURORS VERBALLY ~ U-PON •. ~ EACH JUROR IN PERSON OR BY FIRST CLASS UNITED STATES ~· Cf\;:r MAIL AS THE CITY RECORDER MAY DIRECT; AND DECLARING AN EMER- GENCY. WHEREAS,. the laws of the State of Texas and Ordinances of the City of Lubbo k I are silent on the precise method to be followed in summoning persons for service as jurors in Corporation Court; and I WHEREAS, the current practice of person~! swnmons by police officers of such jurors has proved both cumbersome and unnecessarily expensive; and I c 11 WHEREAS, the City Commission is authorized by Article 8 72 Penal Code, to prescribe by ordinance such rules and regulations concerning the practice and procedure in Corporation Court as may be deemed proper, not inconsistent with any law of this State; and I I WHEREAS, the City Commission finds that summoning of Corporation Court 1 jurors by mail would be proper and in the public interest; and I WHEREAS, all of the above affects the daily operations of a departme nt of I the City of Lubbock, creating an emergency, NOW THEREFORE; BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 25-7 of the existing Code of the City of Lubbock, which will also be Section 25-7 of the revised Code of the City of Lubbock which I will become effe ctive on the Z7th day of April, 1959, BE and the same is hereby amended to read hereafter as follows: 11Sec. 25-7. Execution of process. The Chief of Police shall, in person or by deputy, promptly and faithfully execute all writs and processes issued by the Corp- oration Court; and he and the other Police Officers of the City shall have like power, with the Sheriff of the County, to execute warrants. .Summons for Corporation Court Jurors may be made either verbally upon each juror in person or by first class United States mail, as the City Recorder may direct. 11 SECTION 2.. Due to the fact that this Ordinance deals with the daily operation, of a City Department all rules requi ring the passage of an ordinance by more than one reading are hereby suspended and this Ordinance is declared to be an emer- • / gency measure; and the same shall become effective on the date of its passage. u AND IT IS SO ORDERED On motion of Commissioner ssioner Ma~cr City Commission on this 26th Maxey , seconded by Commi- t the foregoing Ordinance was passed by the day of February , 1959.
