IN CONFUCT OR INCONSISTENT THEREWITH EXCEPT AS HEREIN EXPRESSL
PROVIDED; PROVIDING FOR THE MANNER OF AMENDING SUCH CODE OF ;:-~
ORDINANCES; PROVIDING FOR A COPY OF SAID CODE TO BE PRESERVED( B

LAW OF THE CITY OF LUBBOCK TO BE MISREPRESENTED, AND PROVIDING
A PENALTY THEREFOR; ESPECIALLY EXEMPTING ORDINANCES PASSED
SUBSEQUENT TO THE 11TH DAY OF SEPTEMBER, 1958, FROM THE REPEAL
ING PROVISIONS OF THIS ORDINANCE; PROVIDING FOR PUBLICATION AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE •.
WHEREAS, the City of Lubbock has authority under its Charter and the Laws
{)f the State of Texas to adopt and codify its civil and criminal ordinances, and to
adopt a civil and criminal code of ordinances, together with appropriate penalties
for the violation thereof, which said code when adopted shall have the force and
effect of an ordinance regularly enacted with the usual prerequisites of law; and,
WHE~EAS, the City Commission, of the City of Lubbock, has caused its Ordin
ances of a general and permanent nature to be compiled and revised and the same
are embodied in a compilation and revision thereof known as the "Code of Ordinan e~
City of Lubbock, Texas:11 NOW THEREFORE:
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the Code of Ordinances, consisting of Chapters 1 to 34 eac
inclusive (Volumes I and II), is hereby adopted andenacted as the "Code of Ordin-
, ances, City of Lubbock, Texas11 and shall be treated and considered as a new and
' original comprehensive ordinance which shall supersede all general and permane
ordinances passed by the City Commission prior to September 12, 1958, to the
extent provided for Section 2 hereof.
SECTION 2. THAT all provisions of such Code shall be in full force and effect
sixty days from date this ordinance is finally passed and all civil ordinances of a
general and permanent nature and all criminal ordinances finally enacted before
September 12, 1958, which are inconsistent herewith or in conflict with this Code
are hereby repealed, providing however, that all Ordinances in effect upon the
effective date of this Code not inconsistent with any of the provisions of this revis
Code, shall not be deemed to have been repealed, but shall be continued in full
force and effect unimpaired by this revised Code.
SECTION 3. THAT the repeal provided for in Section 2 hereof shall not affect
any offense or act committed or done or any penalty or forfeiture incurred or any
contract or right established or accruing before the effective date of this ordinanc
nor shall such repeal affect any ordinance or resolution promising or guaranteein
the payment of money for the City, or authorizing the issuance of any bonds of the
City or any evidence of the City's indebtedness, or any contract or obligation
assumed by the City; nor shall such repeal affect the administrative ordinances or
resolutions of the City Commission not in conflict or inconsistent with the provisi s
of such Code; nor shall such repeal affect any right of franchise granted by any
ordinance or resolution of the City Commission to any person, firm or corp oratio

nor shall such repeal affect any ordinance dedicating, naming, establishing.
locating, relocating, opening, paving, widening, vacating, etc., any ~tr~et or
public way in the City; nor shall such repeal affect the annual appropnatlon
ordinance; nor shall such repeal affect any ordinance levying or imposing taxes;
nor shall such repeal affect ordinances prescribing through streets, one-way
streets, speed limits, parking prohibitions, limitations on load of vehicles, or
loading zones, or other traffic regulations, not inconsistent with this Code; nor
shall such repeal affect any parking m .eter or.dinances or regulations; nor shall
such repeal affect any amendment to the zoning map, or zoning ordinances not
inconsistent with this Code; nor shall such repeal affect any ordinance establish•
ing and prescribing the street grades of any street in the City; nor shall such
repeal affect any ordinance providing for local improvements and assessing taxes
therefor; nor shall such repeal affect any ordinances dedicating or accepting any
plat or subdivision in the Cityi nor shall sueh repeal affect any ordinance extend
ing the boundaries of the City; nor shall such repeal affect any building line
ordinances; nor shall such repeal affect any ordinance fixing salaries of the city
officials and employees; nor shall such repeal be construed..fo revive any ordin-
ance or part thereof that has been repealed by a subsequent ordinance which is
repealed by this ordinance.
SECTION 4. Any and all additions or amendments to such Code, when passed
in such form as to indicate the intention of the City Commission to make the sam
a: part thereof, shall be deemed to be incorporated in such Code so that referen
to the Code of Orclnances of the City of Lubbock shall be understood and intended
to include such additions and amendments.
SECTION 5. A copy of such Code shall be kept on file in the of.fi.ce of the City
Secretary, preserved in looseleaf form, or in such other form as the City Secre-

tary or someone authorized by such officer, to insert in their designated places
all amendments or ordinances which indicate the inten'.;ion of the City Commissio
to make the same a part of such Code when the same have been printed or reprint d
in page form, and to extract from such Code all provisions which may be from
time to time repealed by the City Commission . This copy of such Code shall be
available for all persons desiring to examine the same and shall be considered
the official Code of Ordinancesof Lubbock.
SECTION 6. In case of the amendment of any section of such Code for which
a penalty is not provided, the general penalty as provided in Section 1-5 of such
Code shall apply to the section as amended; or in case such amendment contains
provisions for which a penalty, other than the aforementioned general penalty, is
provided in another section in the same chapter, the penalty so provided in such
other section shall be held to relate to the section so amended, unless such penalt
is specifically repealed therein.
SECTION 7. It shall be unlawful for any person, firm or corporation in the Ci
to change or amend by additions or deletions, any part or portion of such Code or
to insert or delete pages or portions thereof, or to alter or tamper with such Cod
in any manner whatsoever which will cause the law of the City of Lubbock to be
misrepresented thereby. Any person, firm or corporation violating this section
shall be punished as provided in Section 1-5 of the Code of Ordinances of the City
of Lubbock.
SECTION 8. Ordinances adopted subsequent to the 11th day of September, 195
shall not be deemed to be repealed by the repealing part of this ordinance but such
ordinances arecontinued in full force and effect.

SECTION 9. THAT the City Secretary is hereby authorized and directed to
cause publication of this Ordinance once a week for two consecutive weeks i n the
official publication of the City of Lubbock.
SECTION 10. This ordinance shall become effective on the sixtieth day after
passage.
