HomeMy WebLinkAboutOrdinance - 2715-1959 - Amending Zoning Ordinance 1695 By Adding Subdivision 6.2-4 - 02/12/1959'· 0~-t ;:;2 -1..9'39 ORDINANCE NO. 2715 · o~-~~-l9~q AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 BY ADlfffiG THERETO~ A NEW SUBDIVISION TO BE DESIGNATED SUBDIVISION 6. 2-4 SO AS TO ESTABLISH PRIVATE COMMUNITY CENTERS AS A CONDITIONAL USE IN AN "R-1" ZONING DISTRICT; DEFINING AND RESTRICTING THE USE OF SUCH COMMUNITY CENTERS; AUTHORIZING THE BOARD OF ADJUSTMENT TO COMPILE A LIST OF USES TO BE PERMITTED AT SUCH COMMUNITY CENTER AND PROVIDING FOR SUPPLEMENTATION OF SAID LIST; PRE- SCRIBING A PENALTY; AND PROVIDING FOR PUBLICATION AND EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the matter of establishing private community centers as a conditional use in an "R-111 Zoning District has been referred to the Planning and Zoning Commission for its recommendation and report, which recommendation and report has been received by the City Commission; and, WHEREAS, the City Commission finds it in the interest of the public health, safety, morals and welfare to amend the Lubbock City Code in accordance with such recommendation and report; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION I. THAT Zoning Ordinance No. 1695 is hereby amended by adding thereto a new Subdivision to be designated Subdivision 6. 2-4 which shall read as follows: 11 6. 2-4 Private community center for the lawful recreational and social use of the residents of a particular addition, subdivision, or housing development which is operated by an associated or incor- porated group of such residents for the use and benefit of such res- idence and their bona fide guests only, provided said community cente'r does not become a nuisance in any manner and/ or interfere. with the peace and enjoyment of the residents living in the area. The Board of Adjustment is hereby authorized and directed to com- pile a list of uses which will be permitted in such community centers, and from time to time said Board, may in its discretion, add additional permitted uses to said list. Said list of uses and any additional uses added thereto, shall be spread upon the minutes of said Board of Adjustment. Said list of uses is hereby made a part of every conditional permit granted for such private community centers as though fully copied therein in detail, and any use added to said list of uses after the granting of a conditional use permit hereunder shall be an amendment to said conditional use permit and shall be a permitted use at such community center without notice and without the necessity of another public hearing in connection there- with. ·.No business for profit use may·be operated at such community centers except that which is strictly incidental to the operation of such community center and is listed by the Board of Adjustment as a permitted use at such community centers. Any person or persons, firm or corporation who shall operate or maintain any use or suffer, per- mit, or allow any use to be operated or maintained at a private com- munity center which is a use not listed as a permitted use at private community centers by the Board of Adjustment shall be deemed to be guilty of maintaining a nuisance, and shall upon conviction be fined in any sum not to exceed TWO HUNDRED AND N0/100 DOLlARS. 11 ·' ~ Jt -~- SECTION 2. The City Secretary shall caus.e this Ordinance to be publishe once a week for two consecutive weeks in a newspaper regularly published in the City of Lubbock and this Ordinance shall become effective ten days after its last publication.
