AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1~ AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW! CHANGE: ZONE CASE NO. 750: CHANGE CERTAIN PROPERTY LOCATED NORTH OF 32ND STREET AND WEST OF AVENUE G FROM AN "R-311 TO AN 11 M-l" ZONING DISTRICT .SUBJECT TO THE FOLLOWING CONDITION: THAT THE OWNERS AND/OR DEVELOPERS SHALL MAKE APPLICATION FOR AND -SECURE A BUILDING PERMIT WITfnN TEN MONTHS AFTER THE DATE OF FINAL PASSAGE OF TillS ORDINANCE. WHEREAS. the proposed change in zoning districts as hereinafter mad has been duly presented to the Zoning and Planning Commission for its recom- mendation, which was received by the City Commission and after Clue considera tion, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and. WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon's. Annotated Civil Statutes, amended i · 1953, and notice was duly published in the Lubbock Morning Avalanche more tha , fifteen (15) days prior to the date of the public hearing before the City Commissi n on such proposed amendment, and the public hearing according to said notice wa duly held in the City Commission Room on the first floor of the City Hall, Lubbo Texas, at which time persons appeared in s4pport of the proposal; and, after sa· hearing, it was by the City Commission determined that it would be in the public interest, due to changed concitions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinanc and this Ordinance having been introduced in final written form prior to first reading hereof; NOW, THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 750 Change the following described property from an 11R-3" to an uM-lTt zoning district, to-wit: BEGINNING at a point, said point being the inter- section of the West right-of-way line of Avenue G. and the North right-of -way line of 32nd Stre·et in the City of Lubbock, Lubbock County, T_exas; THENCE North 229.5 fe.et to a point; THENCE West 125 feet to a point; THENCE South.229. 5 feet to a point; THENCE East 125 feet to the PLACE OF BEGINNING. (Said property being located at the N qrthwest corner of the intersection of 32nd Street and Avenue G). ers.. .,.. Subject to the following condition: That the owners and/or developers shall make application for and secure a build- ing permit within ten months after the date of final passage of this Ordinance. SECTION 2. THAT from and after ·passage and effective date of this Ordinance, said lots, tracts and.parcels of land described in Section 1 hereof shall be changed to the zoning district indicated and the Official Map is amended in accordance herewith. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION l. THAT approval is hereby granted for the e.stablishment of a Base Rate Area as shown on the map attached hereto marked Exhibit 11A 11 and mad 1 a part hereof. Every customer located within this Base Rate Area shall be en- titled to local exchange telephone service at the base rates duly authorized by this Commission. SECTION 2.. THAT standard excess mileage charges shall apply for service furnished customers within the City of Lubbock but located outside of this Base Rate Area. In no case shall the Telephone Company apply its standard excess mileage charges for service within the aforesaid Base Rate Area. SECTION 3. THAT the Base Rate Area of the exchange may be extended by the Telephone Company whenever density of development may justify such exten- sion:. but in no case shall the area shown on the attached map be diminished with- out authorization by the City Commission. A map identical with Exhibit 11A 11 showing the current Base Rate Area shall be maintained in the business office of the Telephone Company. SECTION 4. THAT the establishment of the aforesaid Base Rate Area shall become effective on the first billing date after this ordinance becomes effective in accordance with the Charter of the City. SECTION 5. THAT nothing in this ordinance contained shall be construed as in any manner1 now or hereafter, limiting or modifying the right and power of the City under the law to regulate the rates charged for local exchange telephone service by the Southwestern B.ell Telephone Company for its services within the City of Lubbock, Texas.
