AN ADDITION TO THE CITY OF LUBBOC~ LUBBOCK COUNTY, TEXAS, FROM AN "R-111 TO A 11C-2" ZONING DISTRICT. (SAID PROPERTY BEING LOCATED IN THE 1700 BLOCK OF 45TH STREET). SUBJECT TO THE FOLLOWING CONDITIONS: (1} THAT A SOUD SEVEN FOOT VISUAL SCREEN! WALL OR FENCE OF MASONRY CONSTRUCTION OR THE EQUIVALENT BE CONSTRUCTED ALONG THE WEST SIDE OF THIS PROPERTY. SAID WALL OR FENCE SHALL CONFORM WITH EXISTING ZONING REGULATIONS. (2) THAT THE OWNERS AND/OR DEVELOPERS SHALL MAKE APPUCATION FOR AND SECURE A BUILDING PERMIT WITHIN TEN MONTHS AFTER THE DATE OF 1 FINAL PASSAGE OF THIS ORDINANCE. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recl?mmendati p , which was received by the City Commission and after due consideration, the City I Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock MorningAvcilanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on sue proposed amendment, and the public hearing according to said notice was duly he1 in the City Commission Room on the first floor of the City Hall, Lubbock, Texas, which time persons appeared in support of the proposal; and, after said hearing, i was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended i the mann er hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 741 Change the East 50 feet of the West 100 feet of the South one-half (S 1/2) of Lot 2, Block 5, Syfrett Subdivision. an addition to the City of Lubbock, Lubbock County, Texas, from an 11R-1" to a 11C-211 zoning district. (Said property being located in the 1700 Block of 45th Street). Subject to the following conditions: (1) That a solid seven foot visual screening wall or fence of masonry construction or the equivalent be constructed along the West side of this property. Said wall or fence shall conform with existing zoning regulations. (2) That the owners and/or developers shall make application for and secure a build- ing permit within ten months after the date of final passage of this Ordinance. · '• 0 SECTION 2.
