HomeMy WebLinkAboutOrdinance - 2704-1959 - Amending Zoning Ordinance 1695 And The Official Map Of The City - 02/12/1959.U ORDINANCE NO. 2704 0;2-~~ -,950 AN ORDINANCE AMENDING ZONING ORDINANCE NO. lo95 .KND-'l'RE OFF- ICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOWING CHANGE: ZONE CASE NO. 746: (1) CHANGE TRACT 1 HEREINAFTER DESC- RIBED FROM AN 11R-l11 TO A 11C-311 ZONING DISTRICT • SUBJECT TO THE FOLLOWING CONDITION: THAT THE OWNERS AND/OR DEVELOPERS SHALL MAKE APPLICATION FOR AND SECURE A BUILDING PERMIT WITHIN TEN MONTHS AFTER THE DATE OF FINAL PASSAGE OF THIS ORDINANCE. (Z) CHANGE TRACT Z HEREINAFTER DESCRIBED FROM AN 11R-l11 TO AN 11 R-Z11 ZONING DISTRICT; SAID TRACTS 1 AND Z BEING LOCATED IN THE VICINITY I OF FRANKFORD AVENUE AT 19TH STREET. WHEREAS •. the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommenda- tion which was received by the City Commission and after due consideration., the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS_. all conditions precedent required by law for a valid amendment to I the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section ZO of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953, a~ notice was duly published in the Lubbock Morning Avalanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on such proposed amendment, a~d the public hearing according to said notice was duly held in the City Commission Room on the first floor of the City Hall, Lubbock, I Texas, at which time persons appeared in support of the proposal; and., after said hearing, it was by the City Commission determined that it would-he in the public. I interest., due to changed conditions, that the Zoning Ordinance and the Zoning N-4P I be amended in the manner hereinafter set forth in the body of this Ordinance and" this Ordinance having been introduced in final wriUEn form prior to first reading j hereof; NOW THEREFORE. BE I'i' ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 746 (1) Change the following described Tract 1 from an 11R-l11 to a 11C-311 zoning district, subject to the following condition: That the owners and/or developers s make application for and secure a building permit within ten months after the date of final passage of this Ordinance~ (2) Change the following described Tract Z fro an nR-1" to an "R-Z11 zoning district., both tracts being in the City of Lubbock, Lubbock County, Texas, to-wit: TRACT l. A tract of land out of the Northwest 1/4 of Section 5, Block E-2., Lubbock County, Texas. BEGINNING at a point in the East boundary line of Frankford Avenue, said point being the intersection point of ~Gt,\East boundary line of Frankford and South boundary line of 19th Street; said point also being 45 feet East and 65 feet South of the Northwest corner of said Section 5, Block E-2; THENCE South along the East boundary line of Frankford Avenue 45 feet from and parallel to the West line of (Jaid Section 51 Block E-Z a distance of 1367. 19 feet to a point in the North boundary line of Elkhart Avenue; THENCE East a distance of Z7. 7 feet to a point~ said point being the beginning of a curve to the left, said curve having a radius of ZOO feet and a central angle of 37° -301 1 and a tangent distance of 67. 89leet; THENC~ il?-a Northeasterly direction around said curve a distance of 130. 90/ f~ihe end of said curve; THENCE North 5Z0 -301 East a distance of 851. 51 feet to a point, said point being in the North boundary line of Elkhart Avenue; THENCE North parallel to the West line of said Section 5, Block FrZ a dista~ce of 807.51 feet to a point in the South boundary line of 19th Street; THENCE West along the South boundary line of 19th Street 65 feet South of and parallel to the centerline of 19th Street (Said centerline of 19th Street being the North boundary line of said Section 5;, Block E-Z) a distance of 8Z5 feet to the POINT OF BEGINNING and containing Zl. ZOZ acres., more or less. TRACT Z. A tract of land out of the Northwest 1/4 of Section 5, Block E-Z, Lubbock County, Texas; BEGINNING at a point in the South boundary line of 19th Street., said point being 65 feet South and 870 feet East of the Northwest corner of Northwest 1/4 of said Section 5, Block E-Z; THENCE South a distance of 807. 51 feet to a point in the North boundary line of Elkhart Avenue, said point being the Southwest corner of this tract; THENCE North 5Z0 -301 East a distance of 203. 81 feet to the beginning of a curve to the left, said curve having a central angle of 5Z0 -30'~ a radius of 353. 5 feet, and a tangent distance of 174. 33 feet; THENCE in a Northeasterly direction around said curve a distance of 3Z3. 91 feet to the end o£ said curve; THENCE North along the West boundary line of Elkhart Avenue a distance of 40Z. 98 feet to a point in the South boundary line of 19th Street1 said point being the Northeast corner of this tract; M v THENCE West along the South boWldary line of 19th Street a distance of 300 feet to the POINT and PLACE OF BEGINNING and containing 4. 668 acres., more or less. (Said property being located at the Southeast corner of the inter section of Frankford Avenue and 19th Street}. SECTION 2. THAT from and after passage and effective date of this Ordinanc said lots. tracts., and parcels of land described in Section 1., hereof shall be chang 'd to the zoning district indicated and the Official Map is amended in accordance herewith.
