WHEREAS,. a petition has been filed and considered by the City Commiss .. io~ said petition requesting the City Commission to repeal Ordinances Nos. 2533:, 2535• 2536~ 2544., and 2545 of the City of Lubbock; and,, WHEREAS., The City Commission has rejected said request and iii compliance with Chapter l1t. Article 4a Section li, of the Charter 0£ the City of Lubbock,. and in harmony with the impelling language 0£ the Supreme (:;ourt of Texas in Glassy,. Smi~ 244 S. W.2d. 645~. relating to the duty of the governing body of a municipality to call an election when initiative and referendum proced-- ures have been invoked.it although it considers the subject matter has been with- drawn from such procedurestt-deems it expedient and in the public interest to call a special referenduzn election on the question of whether or not the majority of the voters of the City of Lubbock are in favor of or against the repeal of any or all of said ordinances; ana_ WHEREAS,. the preservation of the healt~ safety1t and property of the Citizens of the City of Lubbock and daily operations of many City Departments is affected by this ordinance• which craates an emergency; NOW THEREFORE, SECTION l. The City CommissiQn of the City of Lubbock,_ Texas~ in accordance with Chapter 10 Article 4,, Section l of the Charter of the City of Lubbock as well as all applicable provisions of the election laws of the State of Texas and the Constitutio~ of the State of Texas,, do hereby order that a special election be held in the City of Lubboc~ Texas,_ on the 27thday of January 19 59, for the purpose of determining whether the voters of the City of J Lubbock are for or against the repeal of Ordinances No. 2533., No. 2535• No. 2536,, No. 2544~ and No. 2545-of the City of Lubbock (more fully hereinafter described). Since this Ordinance affects the preservation of the health,, safety:, and property of Citizens of the City of Lubbock,, and will affect the daily operations of City Departments,, the rule requiring that ordinances be read on two readings is suspended• and this ordinance is declared to be an emergency measure to take effect immediately. -; ,_ SECTION 4.
