I'> I AN ORDINANCE AMENDING SECTION 18-39(A) OF THE LUBBOCK CITY 1 CODE SO AS TO REQUIRE VEHICULAR DRIVERS TO YIELD THE RIGHT-OF .. WAY TO PEDESTRIANS WHO ARE UPON ·oR WITIIlN ANY PORTION OF A CROSSWALK AT AN INTERSECTION WHERE TRAFFIC-CONTROL SIGNALS ARE .O'.nIN PLACE , OR NOT IN OPERATION; PRESCRIBING A PENALTY; PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE; AND DECLARING AN EMERGENCY AND .PROVIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE •. WHEREAS. the City Commission finds that better enforcement of the traffic laws would result if Section 18-39(A) of the Lubbock City Code were amended so as to require vehicular drivers to yield the right-0£-way to pedestrians upon or within any portion of a crosswalk at inter sections where no traffic .. control signals are in place or not in operation; an(¼ WHEREAS~ the City Commission finds that such an amendment is needed for I the immediate preservation of the lives and safety of the citizens of Lubbock~ and such an amendment would affect the daily operation and enforcement of the traffic laws by the Police Department~ which creates a.n emergency; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. Amend Section 18-39(A) of the Lubbock City Code to read hereafter as follows: 11Sec. 18-39. Pedestrians• right-0£ .. way in crosswalks (a) When traffic-control signals are not in place or not in operation the driver of a vehicle shall yield the right-of-way:. slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a crosswalk when a pedestrian is upon or within any portion of such crosswalk but no pedestrian shall suddenly leave a curb or other plac e of safety and walk or run into the path of a vehicle which is so close that it is impossible for the driver to yield. This provision shall not apply under the conditions stated in paragraph (b) of Section 18-40 of this code. SECTION 2. Any person, firm, or corporation violating any provision of this ordinance -a~ upon conviction be fined in any smn not to exceed TWO HUNDRED AND NO/100 ($200. 00) DOLLARS. SECTION 3. The City Secretary shall causethis ordinance to be published once a week for two consecutive weeks in a newspaper regularl y published in the city of Lubbock. 5 _:;.__,,..sE.C-t'ION 4. The immediate preservation of the lives and safety of the citizens of Lubbock and the daily operation of the Police Department of the city of Lubbock require that this ordinance be declared an emergency measure, and the rule requiring that ordinances be read on two separate readings before final passage is hereby suspendeda. and this ordiµance shall take effect immediat ly.
