AN ORDINANCE DECLARIN:G A NUISANCE THE STORAGE IN POROUS
, EARTHEN TANKS OR PITS WITlilN THE CITY AND OUTSIDE THE CORPORATE
LIMITS OF THE CITY OF LUBBOCK FOR A DISTANCE OF FIVE THOUSAND
FEET (5, 0001) ANY SALT WATER~ SULPHUR CONTAMINATED.WATER, OR AN
OTHER IMPURITIES BROUGHT TO THE SURFACE THROUGH DRILLING OPERA
TIONS., WHICH ARE CALCULATED TO CONTAMINATE~ POLLUTE OR RENDER

operating of oil and/ or gas wells within the City Limits _and :within 51 000 feet out-
side the City Limits of the City of Lubbock are ..making a practice of storing salt
water, sulphur contaminated water and other impurities brought to the surface by
drilling operations, in porous earthen tanks or pits; and1
WHEREAS, the c ·ity Commission finds that the normal seepage of all such
impurities from such porous earthen tanks or pits is calculated to eventually
reach underground and percolating waters and thereby to pollute, contaminate
and render such underground and percolating water unpalatable to the taste; an~
WHEREAS,. the City Commission finds that the protection and conservation of
pure underground and percolating water is necessary and essential to protect the
healt~ property1 and good order of the City of Lubbock and its inhabitants; NOW
THEREFORE~
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION l. THAT it shall constitute a nuisance for any person, firm,
associatio;n of persons1 or corporation engaged in the drilling or operation of oil
or gas wells to place or deposit in porous earthen storage tanks or pits within the
City and outside the corporate limits of the City of Lubbock for a distance of five
thousand (51 000) feet~ any salt water2. sulphur contaminated water1 or any other
impurities-, brought to the surface through drilling operations, calculated to con-
taminate1 pollute or render unpalatable percolating and underground water. Such
nuisance shall be subject to abatement as provided for in Sections 15-29 to 15-34
of the Code of the City of Lubbock.,. 1955.
SECTION 2.. THAT the nuisance hereinabove defined is prohibited within the I City and within a distance of five thousand feet outside the corporate limits of the
City of Lubbock,, and any person, firm,, association of persons, or corporation
making7 causing,permitting, suffering or maintaining the nuisance defined, shall.
be guilty of a misdemeanor and upon conviction thereof shall be fined in any swn
not exceeding $ZOO. 00 and each day that such nuisance exists or continues shall
constitute a separate offense.
SECTION 3. THAT the City Secretary is directed to publish this Ordinance
once a week for two weeks in the of;i.cial publication of the City of Lubbock., and
this O~dinance shall become effective ten {10) days after its last publication.
