AN ORDINANCE ESTABUSIIlNG BUILDING LINES ON THE WEST AND=~, ..
SIDES OF AVENUE HAT THE PLACE AND LOCATION AS MORE PARTICULAR
DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE;
PROVIDING THAT NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER
ERECTED, RE-ERECTED, OR SUBSTANTIALLY REPAIRED BETWEEN SUCH
BUILDING llNES; REQUIRING EXISTING STRUCTURES ON OR BETWEEN THE
BUILDING llNES HEREIN ESTABLISHED TO CONFORM TO SUCH BUil.DING
LINES WITHIN FIVE (5) YEARS; DEFINING BUILDING UNE AND PROVIDING
THAT SET BACK REQUIREMENTS UNDER THE CITY1S ZONING ORDINANCE
MENDMENTS THERETO BE DETERMINED FROM THE BUILDING LINES HER
IN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTILITY EXTENSIONS AND
PUBLIC IMPROVEMENTS; PROVIDING A SAYINGS CLAUSE.
WHEREAS, Article 1105a, Revised Civil Statutes of Texas provides for the
establishment of building lines on any part or side of any street in the City of
Lubbock, said city having a population of more than 15,000 persons; and,
WHEREAS, the City Commission finds that public convenience, safety and
necessity in the City of Lubbock require that building lines or rights -of-way lines
be established on the West and East sides of Avenue Hat the place and location
mnre particularly described by metes and bound.s in the body of this ordinance, t
prevent repair and replacement of structures and trees in the area between the
building lines as established; such areas being required in connection with widen-
ing, opening and improving that part of Avenue Has hereinafter described; and,
-WHEREAS, the widening and improving of Avenue Hand the establishment

of such building lines are necessary and will ultimately provide streets of desirab e
and adequate width which will aid and relieve heavy traffic in congested areas in
accordance with the city's comprehensive p1an, and the city's planning commissio
has reccommended such plan. The City Commission further finds that such
establishment of building lines at this time will promote economy; NOW THEREF
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT a building line is hereby established on the West and Ea It
sides of Avenue Hat the place and location as hereinafter described and within";
the corporate boundaries of the City of Lubbock, Lubbock County, Texas, which
building lines are more particularly described as follows, to-wit:
WEST SIDE:
BEGINNING at a point in Section 5, Block E, Lubbock
County, Texas, said point being 2636. 3 feet South and
2313. 5 feet East of the Northwest corner of said Section
5, Block E;
THENCE South 46,0 331 East a distance of 203. 8 feet to
a point of curvature;
THENCE Southeasterly along said curve, the radius point
of said curve bears South 43°271 West 215 feet,a curve distance
of 174. 5 feet to a point of tangency;
THENCE South 0°031 East a distance of 16 7. 7 feet to
a point;
EAST SIDE:
THENCE South 0°11 1 East, a distance of 2ll. 8 feet to a
point, said point being 591 West of the West line of US
Highway 87;
THENCE Southeasterly 647 feet more or less to the
Northeast corner of the Winniewood Addition to the City
Of Lubbock, Lubbock County, Texas;
THENCE Southerly along the West right of way line of
US Highway 87, a distance of 1290 feet more or less to
a point 30 feet North of the South line of Section 5, Block
E, Lubbock County, Texas.
BEGINNING at a point in the North line of Lot 2, Block
12, Smithlawn Addition to the City of Lubbock, Lubbock
County, Texas, said point being zo. 3 feet East of the
Northwest corner of said Lot 2;
THENCE Southwesterly along a circular curve to the right,
the radius point of said curve bears North 66°441 West 327
feet, a distance of 150. 9 feet to a point in the South line
of Lot 4, Block 12, Smithlawn Addition to the City of
Lubbock, Lubbock County, Texas, said point being 29. 3
·feet East of. the Southwest corner of s~d Lot 4;
THENCE continuing along said curve across 75th Street. a
distance of 35. 6 feet to a point of tangency;
THENCE South 55°571 West a distance of 51. 3 feet to a
point in the North line of Lot 5, Block 13, Smithlawn
Addition to the City of Lubbock, Lubbock, County, Texas,
said point being 9. 9 feet Ea st of the Northwest corner
of said Lot 5; ...,
THENCE South 55°571 West across Lots 5, 6, and 7 of
said Block 13, Smithlawn Addition to the City of Lubbock,
Lubbock County, Texas, a distance of 150. 5 feet more or
less to a point in the East line of Lot 9. Block 13, Smith-
lawn Addition to the City of Lubbock,Lubbock County, Texas,
said point being 28. 9 feet South of the Northeast corner of
said Lot 9;
THENCE South along the West property line of the N 0 rth-
South alley in Blocks 13, 14, and 21, Smithlawn Addition
to the City of Lubbock, Lubbock County, Texas, and
Blocks 8, 9, 14, 15, and 22, Martin-Ameen Addition to
the City of Lubbock, Lubbock County, Texas, to a point
in the North property line of 82nd Street, said point being
30 feet North of the South line, Section 5, Block E,
Lubbock County, Texas.
SECTION 2. THAT no building or other structure shall hereafter be erected
re -erected or substantially repaired and no new structure or parts thereof shall be
1erected on that part of the street or land herein designated within said building line
tiereinabove described.

SECTION 3. THAT all structures on or between the building lines
established by this Ordinance or extending in whole or in part within such build-
ing lines are hereby required to conform to the new building lines established in
Section One (1) of this Ordinance within five (5) years from the effective date of
this Ordinance.
SECTION 4. THAT the term "Building Line" as herein used shall be con-
strued to mean 11 street right-of-way line11 , and the setback requirements under
the City's Zoning Ordinance and all amendments thereto shall apply in fli~ition
to the right-of-way lines or building lines herein established, it being/in.tent and
purpose of this Ordinance to preserve all land within the building lines herein
established for ultimate street purposes.
SECTION 5. THAT the provisions of this Ordinance shall not apply to any
officer, agent, employee or other person duly authorized by the State of Texas a /
or the City of Lubbock when performing any employment pursuant to the widening
straightening or extension of the street and/or the 'r'ight-of-way contemplated by
this Ordinance or authorized utility extensions within the right-of-way herein
described.
SECTION 6. If any section, paragrap h, subdivision, clause, phrase or
provision of this Ordinance shall be judged invalid or held unconstitutional, the
same shall not affect the validity of the remain<ler of this Ordinance as a whole
or any part of provisions thereof other than the part so decided to be invalid or
unconstitutional.
