WHEREAS, the City Commission finds that heretofore Ordinance No. 587 wasv enacted as the Building Code of the City of Lubbock to regulate the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height ., area and maintenance of buildings and/or structures in the City of Lubbock; and, WHEREAS, in spite of prior amendments by Ordinances No. 675, 711, 742, 818, 851, 873, 1012 and 1035 said BUilding Code has not kept pace with the innovations and professional advancements of the building and construction industry; and, WHEREAS, the City Commission finds that such industry-wide innovations and advancements constitute acceptable practices which should be recognized by the Building Code; and, WHEREAS, the City Commission finds it would be to the public interest, saf~ty, health and general welfare, that certain amendments, revisions, dele- tions and/ or additions be made to the Building Code of the City of Lubbock as hereafter set forth in the body of this Ordinance; NOW THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT certain amendments, revisions, deletions and/or additions be made to Ordinance No. 587 as heretofore amended by Ordinances Nos. 675, 711, 742,8 8, -. ··"' ~ 851, ;873, 101Z1 and 1035 (being the Building Code of the City of Luobock and bein hereinafter referred to as "Building Code") as follows: of the Building Code . 1:. THAT the first paragra:ph of Sec. ZOVbe amended to read herer ·.after as follows: 11No person shall erect or construct or prcoceed with the erection or con- struction of any building or structure1 nor add to, enlarge, move, improve, alter repair, convert., extend, or demolish any building or structure or cause the same to be done, without first obtaining a building permit therefor from the building inspector except that upon application and authorization of the building inspector a building permit may be waived on small and unimportant work. No permit will be required for normal repair and maintenance of any building. 11 Z: THAT Sec. Z03 of the Building Code Be and the same is· hereby amended to read here~ tafter as follows: "Any _t)erson desiring a building permit shall, at the time of filing an application therefor, as provided in section ZOl of this Code, pay to the building inspector a fee as required in tlia Section. New buildings and additions. Minimum fee, $1. 00. All types of buildings per square foot of floor space, $0. 0075. Open shed, cotton warehouses and other buildings of similar type, $0. 005 per square foot of floor space. Gasoline or other volatile or inflammable liquids storage plants, $5. 00. Service station storage ·tanks $Z. 50 per tank. Alteratmnse.:. For alterations of old buildings the fee for permits shall be one-tenth of one per cent of the value of such alteration. Minimum fee $1. 00 • . The city,· county, state,) or the United States of .Alnerica shall be exempt from the paying of any fee for any building. · Where work for which a permit is required by this Code is started or proceeded with prior to ol:laining said permit, the fees above specified shall be doubled, but the payment of such double fee shall not relieve any persons from fully complying with the requirements of this Code in the execution of the work nor from any other penai.i ties prescribed herein. The building inspector shall keep a permanent, accurate account of all fee and other moneys collected and received under this Code and give the names of th persons upon whose account the same were paid, the date and amount thereof, together with the location of the building or premises to which they relate. 11 3; THAT the seventh paragraph of Sec. 204 of the Building Code BE and the same is hereby amended to read as follows 11Final inspection: To be made after building is structurally completed an acceptable for occupancy in accordance with requirements of all related codes pertinent to the premises and structures. " ~ 4: , ~HAT the eleventh paragraph and all following same in Sec. 204 of t-h-e-==~= Building Code Be and the same is hereby amended to read hereafter as follows: ~ BOND FOR GENERAL OONTRACTORS AND ------------OTHERS------------ Any person, firm or corporation desiring to engage in the business of general I contracting in the City of Lubbock, shall file with the Building Inspector, to be approved by the City Attorney or an authorized assistant as to form and condition and such approval has been written on the face of the bond, the same shall be immediately effective and the principal deemed to have complied with the bond provisions of this code~ a surety bond in the swn of FIVE THOUSAND($5a 000. 00) DOLLARS, conditioned on a faithful performance of all the provisions of tlis code, such surety to be a company authorized to transact business in the State of Texas. All sureties on any bond required by the City shall be liable for breach thereof to the owner of the property and any other person actually damaged by such breach not to exceed the face amount of said bond.t provided written notice of such damage and probable amount thereof is given to the surety within ten days after the dis- covery of the damage011 and in no event not later than 90 days after the completion or abandonment of the work by such contractor and provided that no permit shall be granted and no work started on the contract until such bond has been filed and approved by the City Attorney or an authorized assistant as to form and condition I and such approval has been written on the face of the bond, the same shall be immediately effective and the principal deemed to have complied with the bond provisions of this code~ and provided further that liability on said bond for the full amount thereof shall continue until the surety has given city written notice of cancellation or of amount of claims it has been notified of in which event contracto shall not pursue work further until bond for full amount is filed and approved. Bond for Other Contractors All other contractors and subcontractors engaging in contracting business, such as that of plumberj,, gas fitters, electricians., carpenters, plaster s1 masons and I house movers shall furnish similar bond in the swn of $31 000. 00;) said bond to be subject to the same conditions and liabilities as provided for the General Contracto 11 bonds hereinabove. No persn, or persons shall hereafter move any building within the limits of the City of Lubbock,, Texas, where the same shall be moved in~ through orLupon the streets, alleys,. avenues, or public g£aunds1 unless said person, shall, before moving said house or bui.~lding secure a permit to do so from the Building Inspecto • =-======tt=!=--The owner shall pay for said permit, Buildings up to and less than 400 ~quare ,~ feet in area~ One ($1. 00) Dollar. One (1) story house Two Dollars Fifty Cents ($2. 50). Two (2) story house Ten ($10. 00) Dollars, and larger structures Twenty- Five ($2.5. 00) Dollars. In addition to the above fees for moving, a fee of Two Dollars Fifty Cents ($2.. 50) will be charged for each day in excess of two days that the building obstructs street or alley. No permit will be required of contractors for moving tool or storage houses, but same shall be removed from building site upon completion of contract. I Before said permit is granted by the Building Inspector, the party applying ther - for shall give a bond in the sum of THREE THOUSAND ($3, 000. 00) DOLLARS with good and sufficient sureties to be approved by the City Attorney or an authorized assistant as to form and condition and such approval has been writte.n on the face the bond, the same shall be immediately effective and the principal deemed to have complied with the bond provifions of this code, conditioning among other things tha 1 said party will save1 indemnify and keep harmless the CD¥ of Lubbock, Texas7 aga E all liabilities~ judgments, costs and expenses which may in any way accrue agains said city in consequence of the granting of the said permit_, and upon the expiration of the time named in the permit, or sooner if the use of the streets, alleys, avenuEfjs or public grounds is no longer necessary, he shall clear same o£ all obstructions. Further, the Building Inspector may refuse to issue a removal permit in a case 'where such work will necessitate the removal or cutting of any wires belonging to a public utility company, or to the city;~ until such time as the party making application for such permit shall have made satisfactory arrangements with the party or parties owning or controlling such wires~ either by written agreement or by depositing with said company a sufficient amount of money to cover the cost of such work, that is~ cutting and replacing the wires so moved or cut, to the satis- faction of the parties owning or controlling same. Contractor r e Liability--Bond II Any person~ firm or corporation using explosives shall give a bond to be approved by the City Attorney or an authorized assistant as to form and condition and such approval has been written on the face of the bond~ the same shall be immediately effective and the principal deemed to have complied with the bond provisions of this code, conditioned upon payment of all damages caused by said excavation or use of explosives in the amount of Five Thousand ($5, 000. 00) Dollar • In cases where work is extremely hazardous the amoun~f the bond shall be no ars increased not to exceed Fifty Thousand ($50, 000. 00)/at t e c1iscretion of the Build- ing Inspector. I . .:::.··:: -c:13 :.: ~-~ ;,~.'4 -......,: In addition to the inspections to be made as specified in Section 2.04, the owner or his agent shall employ a special inspectum who shall be present at all times during construction on the following types of work: 1. CONCRETE: On concrete work when the de sign is based on an f 1c, in excess of 2000 pounds. 2.. MASONRY: Masonry work shall have special inspection when required in Chapter 24. 3. WELDING: On all structural welding. 4. REINFORCED GYPSUM: When cast-in-place reinforced gypsum is be· g mixed or deposited. 5. SPECIAL CASES: On special construction or work involving WlUsual hazards or requiring constant inspection. EXCEPTION: The Building Official may waive the requirement for the employment of a special inspector if he finds that the construction or work is such that no unusual hazard exists. Special Inspector. The special inspector shall be a qualified person appro ec by the Building Official. ~ The special inspector shall fu.rnis:h continuous inspection on the constructiop and work requiring his employment. He shall report to the building iMipecitoll" in writing.,. noting all Code violations and other information as required. 5. THAT the 3rd paragraph of Sec. 302. of the Building Code BE and the same is hereby amended by adding thereto, the following sentence: "Once such alternative types of construction or materials have been appro ec the building inspector shall a:llow all subsequent applicants to use the same type of construction or material on the same class of construction project. 11 6. THAT Sec. 304 of the Building-Code BE and the same is hereby amended t read hereafter as follows: 11In order to determine the suitability of alternate materials and types of construction and to. provide for reasonaltle interpretations of the provisions of this Code, there shall be and is hereby created a Board of Examiners and Appeals., con sisting of five members who should whenever practicable he chosen from among 1 architects.J builders, lawyers, structural engineers and/or other persons qualifie by experience and training to pass upon matters pertaining to building constructio The building inspector shall be an ex officio member and shall act as Secretary of the Board. The Board of Examiners and Appeals shall be appointed by the City Commission and shall hold office at their pleasure. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the building inspector with a duplicate copy to the appellant and may recommend to the City Commission such new legislation I as is consistent therewith. The Board of Examiners and Appeals may interpret the provisions of this Code to cover a special case;~~ if it appears that the proviaons of this Code do not definitely cover the point raised or that a. manifest injustice might be done# provide that every such decision shall be by unanimous vote of the Board of Examiners a.nd Appeals. Decisions as to the use of alterrstematerials and/or types of constructio1 shall be by majority vote and if expressly prohibited by this Code shall become effective only when authorized by an amendment to this Code. 11 7: THAT the last paragraph of Sec. 306 and all of Sec. 307 oi the Building Coc:if BE and the same are, hereby repealed. 8: THAT the term "suggested Fire Prevention Ordinance, Edition of 1933" at all places where same appears in the Building Code BE and the same is hereby I amended to read hereafter: "suggested Fire Prevention Code, Edition of 19 53. 11 9: THAT Sec. 1001 of the Building Code BE and the same is hereby amended I by adding thereto the following footnote7 to-wit: 11Note--Highly flammable liquids shall be deemed to be those with a flash point below 190 degrees Fahrenheit as determined by the closed cup tester~ provided that liquids with a flash point above 138.5 degrees Fahrenheit shall not be deemed to be highly flammable when used in a closed safety cleanitg system meeting _the requirements of U. B. c. Standard No. 10 .. 1 for a class III rating. 11 10: T'E<IAT all of Sees. 1311 and 1312 of the Building Code BE and the same are hereby repealed~ II !!. I 11: THAT Sec. 1402 of the Building Code BE and the same is hereby amended tw read as follows: "Buildings or parts of buildings classed in Group I because of use or the character of the occupancy shall be of Types I, II1. II~ IV or V ..Construction. The floor areas of Types I and II shall be unlimited, the floor areas of Types III and IV shall be limited to ten thousand square feet (10~ 000 sq. ft. h and the floor area of Types V shall be unlimited. 12: THAT Sec. 1405of the Building Code BE and the same is hereby amended to read as follows: "All rooms of Group I occupancies used for eating~ living and/or sleeping purposes shall be provided with light and ventilation by means of windoV~A~_ with an area not less than one .. eighth of the total floor area of such room or rooms. In lieu of the foregoing requirements a mechanical ventilatigg system to the outside air may be installed in a portion of this area upon approval of the Building Inspector. · "Light~ ventilation and sanitation shall be provided as specified by any state laws which are intended to regulate such light, ventilatinn.:1 and &anitation." 13: THAT Sec. 1602~ paragraph (i) BE and the same is hereby amended to read as follows: "(i) Group E. No. GroupE occupancies except public garages, gasoline filling stations or dry cleaning plants not using highly flammable liquids shall be constructed or erected in Fire Zone No. 1 and no existing buildings shall be used or occupied in any manner whatsoever by Grade E Occupancies except as public garages, gasoline filling stations, or dry cleaning plants not using highly flammabl liquias. 11 14: THAT Sec. 16031 paragraph (g) BE and the same is hereby amended to read as follows: Group "(g) Group E. No./E occupancies except public garages~ gasoline filling stations or dry cleaning plants not using highly flammable liquid shall be construct d or erected in Fire Zone No. 2. and no existing buildings shall be used or occupied · any manner whatsoever by Gllapp E occupancies except as public garages1 gasoline! filling stations or dry cleaning plants not using highly flammable liquid. 11 15: THAT the last paragraph of Sec. 2016 of the Building Code BE and the sam is hereby amended to read as follows: 11 Noncombustible insulating materials may be placed in the partitixm1 floor or roof framing but shall in no way interfere with the fire blocking or fire separa- tions required by this Code. 11 U 16: THAT the first five paragraphs o£ Sec. 2205 of the Building Code down to but not including the paragraph which begins "Maximmn allowable height, etc." an ends "· •• Perpendicular to the direction of the stqc:lewall" BE and the same are hereby amended to read as follows: EXTERIOR WALLS AID WALL COVERINGS Section 2205. Exterior walls of all type V buildings having a .floor area of four hWldre.d square feet (400 sq. ft.) or more shall be constructed with studding not less than two inches by four inches (211x 4") spaced not more than twenty-four inches (2411 ) on centers;~~ or such walls may be constructed of not less than four inc I by four inch (411 'x 4 11) posts spaced not more than five feet (51) on centers or of larger members designed as specified in Chapter 25, or may be of post and beam framing with pla~ sheathing not less than one and one-half inches (1 1/211) thick I or rna y be of pimi nated construction not less than four inches ( 4 11) nominal in thickness with the structural assembly properly designed to support all loads • ..._.....-----.._ u Buildings two stories in height shall have walls constructed as specified above~ except studding shall be not less than two inches by four inches (211 x 411) spaced not more than sixteen inches on center. Buildings three stories in height shall have the first story studs not less than two inches bysix inches (2" x 6••) I spacec;l not more than sixteen inches (16") on centers. Underpinning shall be not less in size than the studding of the story above) provided,. that all underpinning exceeding four feet (41) in height shall be not less in size than the studding required for an additional story. All such underpinning shall be effectively braced. Where studs continue through more than one story~ joists shall be nailed securely to the studs and shall be supported upon a one inch by three inch (1 11 x 311) ribbon_, notched into the studs and securely nailed thereto;~~ or by other means affording equivalent strength and rigidity. Where stories are framed separately;~~ I each tier of studding shall have top and bottom plates and the top plates shall be doubled and lapped at all corners and intersections. Laps in separate pieces of th top plate shall be staggered not less than four feet (41). All exterior walla and partitions shall be thoroughly and effectively angle braced. When one inch nominal wood sheathing is used for covering on outside walls and applied diagonally .. this will satisfy the requirements for angle bracing. When one-half inch (1/2") plywood is used for exterior sheathing, in 4 1 x 8 1 panels or large;r this will suffice for angle bracing. 17: THAT Sec. 2205 of the Building Code BE and the same is hereby amended t add thereto after the paragraph entitled "(a) Weatherboarding" the following: Plywood may be used for siding as following: · a. Minimum thickness Maximuzn stud spacing 5/16 -inch 16 inches 3/8 -inch 24 inches b. Types of finish which affect the minimuzn thickness of plywood used: (1) Under wood shingles: if 5/16-inch plywood is used;~~ apply shingle~ over 1 x 2-inch nailing strips using copper or galvanized nails for attaching the shingles. Nailing strips may be omitted if barbed nails are used for attaCbi.n:g'.fhe shingles. 1 (2) Under asbestos-cement shingles and siding: if 5/16-inch thick plywood is used• apply siding or shingle material with barbed nails •. Do not apply over wood nailing strips. 18: THAT Sec. 2211 of the Building Code BE and the same is hereby amended to read hereafter as follows: Sec •. 2211. Roof construction may be of any type of construction permitted in this code. When roo£ construction is of wood it shall conform to the require- ments of Chapter 25. .. Attic or roof spaces shall be divided into areas not exceeding•twenty-five hundred square feet (2500 sq. ft.} as specified in Section 3405. Roof.covering shall be a ttFire Retardant" roofing, except that for Groups H, I and J occupancies, an ordinary roofing.may be used as specified in Section 4305.
