HomeMy WebLinkAboutOrdinance - 2621-1958 - Amending Zoning Ordinance 1695 And The Official Zoning Map Of The City. - 10/23/1958WHEREAS, a proposed change in zoning districts has been duly presented to the Planning and Zoning Commission and said Planning and Zoning Commission has made a recommendation against said proposed change to the City Commission; and, WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon1s Annotated Civil Statutes;~ amended in 1953, and notice was duly published in the Lubbock Morning Avalanche more than fifteen 1 (15) days prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the City Commission Room on the first floor of the City Hall, Lubboc Texas~ at which time persons appeared in support of and against the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public intere st1 due to changed conditions, that the Zonir.g Ordinance and the Zoning Map BE amended so as to change the prope~ty as hereinafter described from an "R .. I 11 to a "C ... 311 Zoning District; NOW THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 702 Change Lots 1 and 2:~ Block 1 and Lots 1 and 2;7-Block 15 all in Southport Addition to the City of Lubbock,,-Lubbock County, Texas, from an 11R-l11 to a 11C-311 Zoning District, subject to • the following conditions: (1) That the adjacent residential property be protected by visual screenitig'"' to consist of a solid masonry wall or the equivalent at least seven feet in height, to be constructed along the south property line of Lots 1 and 2.,, Block 15 and the East property line of Lot 2., Block 15 and along the South property lines of Lots 1 and 2.~ Block 1 and the West property line of Lot 2.~ Block 1, Southport Addition. These walls shall be reduced in height to 2. and 1/Z. feet for a distance of 10 feet from the rights-of-way lines of Avenue Q and for a distance of 15 feet from the South right-of-way line of 38th Street. (Z.) That any illwnination on pole standards shall be deflected downward so as not to constitute a nuisance to the adjacent residential properties. (3) That a Building Permit be applied for within one hundred eighty (180) days from October Z.3;jl 1958. SECTION 2.. THAT from and after passage and effective date of this Ordinance said lots,, tracts and parcels of land described in Section 1 hereof shall be changed to the Zoning District indicated and the Official Map is amended in accordance herewith.
