AN ORDINANCE RELEASING AND AUTHORIZING THE MAYOR TO JOIN WITH PIONEER
PAVERS, lNCoo.POBATED, PAVING CONl'RACTORS, IN A RElEASE OF PAVING ASSESSMENTS
ON PROPERTY ABtrrriNG A PCllTION OF on'ORD AVENUE, REDBUD AVENUE, 47TH STREET,
GUAVA AVENUE, AND THE ALlEY BE'l.'WEEN AVENUE L AND AVENUE K AND BE'l'WEEN 15TH AND
16TH STREETS, SUCH RElEASE BEING LlMl'l'ED TO THE PROPERTY ABUTTING THE PORTION
OF THE PAVING SUB-UNIT SPECIFICALLY DESCRIBED IN THIS <lU>INANCB AND TO THB
ASSiSSMENTS MADE UNDER PAVING OlU)!NANCE NO. 2268, UNDER G.W.O. 2103, AS RECORD-
ED IN VOLUME 669, PAGE 149, DEED BEC<lU>S OF LUBBOCK COUNtY, TEXAS.
WBIBEAS, the City of Lubbock on or about the 22ud day of August, 1957
passed its Paving Ordinance No. 2268, which ordinance levied and assessed
various properties in the City of Lubbock certain specified amounts for street
illlprovement purposes; and,
WHEREAS, such Ordinance was filed in the Deed Records of Lubbock
County, Texas, on the 13th day of September, 1957 in Volume 669, Page 149,
constituting an apparent lien on properties contained therein; and,
WHEREAS, Pioneer Pavers, Incorporated, Paving Contractors, contracted,
as set out in such Ordinance, to pave all that property contained in such
Ordinance, but such paving as planned vas not carried out in its entirety as
orialnally planned, for the reason that said Pioneer Pavers, Incorporated,
Paving Contractors, were unable to obtain sufficient legal guaranty of payment
on certain properties abutting the paving sub-units or portions thereof herein•
after designated, and the said Pioneer Pavers, Incorporated, Paving Contractors
are willing and agreeable to abandon and not pave any portion of the herein-
after described sub-units or portiQOs thereof, and,
WHEREAS, the present owners of such property are desirous of obtaining
a release on all that property abutting those paving sub-units or portions
thereof hereinafter described which has not bee• paved, and there being no
intent in the ~diate future plans of the City for such paving, and the City
COIDbsion deems it wise and expedient to abandon such paving, which action
bas resulted in the abandonment of the assessment liens asainst the property
abutting such paving sub-units or portions thereof hereinafter specifically
designated; THEREFORE,
BE rr OR.IlA.INED BY THE CITY C<HIISSION OF THE CITY OF LUBBOCK:
THAT the paving liens created by Ordinance No. 2268, recorded in
Volume 669, Page 149, Deed Records of Lubbock County, Texas, against those
lots, tracts or parcels of land abutting the hereinafter described paving
sub-units or portions thereof are hereby in all things released, and the
Mayor is heretiy authorized and directed to join with Pioneer Pavers, Incorpo-
rated, Paving Contractors, in the execution of a release to be filed with the
County Clerk of Lubbock County, Texas, said property so released being liaited
to the property abutting the paving sub-units or portions thereof hereinafter
described, all of which are lying and being situated in Lubbock County, Texas,
and further described as follows, to-wit:
Sub~Unit No.6 of Unit No. 1889; Oxford Avenue from SPL 30th Street to NPL
31st Street.
Sub-Unit No . 10 of Unit No. 1889; Redbud Avenue from SPL East Broadway to NPL
East 13th Street (East Leg).
Sub-Unit No . 12 of Unit No. 1889; 47th Street from EPLAvenue G tow. Paving
Line A venue D.
Sub-Unit No. 3 of Unit No. 1890; Redbud Avenue from NPL East 13th Street to
N. Paving Line East 14th Street (East Leg).
Sub-Unit No . 4 of· Unit No. 1890; Guava Avenue from S. Paving Line Parkway
Drive to NGL East 2nd Street.
Part of Sub~Unit No. 5 of Unit No. 1890; Guava Avenue from NIL East 3rd Place
to SPL East 2nd Street.
Unit No. A-313; North-South alley in Block 179, Original Town between Avenues
L and K and between 15th and 16th Streets.
AND IT IS SO ORDERED.

on first reading this 9th day of October , 1958, by
the following vote:
