WHEREAS, the City Commission finds that the aforesaid alley, as A./~ hereinafter more particularly described is no longer nee ded for alley purposes
~~-,f or for public use; and,
t WHEREAS, the City Commission finds it would be to the public interest
to close, vacate and abandon same for alley purposes and to public use; NOW
THEREFORE,
BE IT ORDAINED B.:Y THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT the alley South of Erskine Street and East of Niter
Avenue, as hereafter described shall BE and the same is hereby closed,
vacated and abandoned for alley purposes and for public use; said tract-of
land being more particularly described as follows, to-wit:
That part of the Northeast one-fourth (NE 1/4) of ·
SURVEY THREE {3), BLOCK A, Lubbock County ,
Texas, described b y metes and bounds as follows:
BEGINNING at a point 174.9 feet West of the NE' corner
of said Section, being also the NE corner of tract
conveyed to H. H. Whitney to Oscar Paden according to
deed recorded in Volume 422, Page 163, Deed Records
of Lubbock County , Texas, and in the middle of East-West
road;
THENCE South at 25 feet cross South boundary line said
road, in all 53 feet to SE corner said Paden tract;
THENCE Southwesterly a distance of about 400 feetto
a point in the SW corner of tract conveyed to H. K. Brown
by H. H. Whitney et ux, dated May 17, 1951;
THENCE South 17 feet to a point;
THENCE NE 58°5t a distance of about 415 fee t to a point
in the West line of a tract conveyed to Oscar Paden by deed
recorded in the Deed Records of Lubbock County, Texas;
THENCE North along the West line said last mentioned
Paden tract to the North line of said section;
THENCE West 15 feet to the PLACE OF BEGINNING.
SECTION 2. THAT the City Engineer is hereby authorized and
directed to mark the offici;;tl map of the City of Lubbock to indicate that
the alley as described in Section 1 hereof, has. been closed and abandoned,
s howing the number of this Ordinance and the date of its final passage.
AND IT IS SO ORDERED.
