D . 57} 00-\ \-\OC/2> OIU11NANCE NO. 2586 a;~ ~/ ~ .... / Al'f ORDINANCE AUTHORIZING THE ALTERING AND CHANGING OF THE PRIMA ' FACIE SPJ!:ED LIMIT FROM 30 MILF.;S PER HOUR TO 15 MILES PER HOUR ON THAT PORTION OF fHE STREETS DESCRIBED AS FOLLOWS: In the alle,r between 33rd Street and '~th Street and ATenue U and ~Tenue V. AUTHORIZING THE PLACING OF SPEED LIMITS SIGNS; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY; AND PROVIDING FOR THE EFFECTIVE DATE OF TinS ORDINANCE. WHEREAS, the governing body. as authorized by Article 8Z7a, Sec. 8, Vernon1s Annotated Penal Code. finds that certain prima facie speed limits on certain highways are different from what is reasonable or safe and should be altered and the immediate preservation of public health and safety requires immediate alteration of said prima facie speed limits as hereafter set forth. which creates an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COM.MISSION OF THE CITY OF LUBBOCK: SECTION 1. The prima facie speed limit established by Article 8Z7a, Section 8, Supsecti.on 1 (b) 1, Vernon's Annotated Penal Code, is altered and changed for all vehicles to 15 miles per hour on the following designated highways or streets in the corpo~ rate limits of ~~e City of Lubbock,. Lubbock County, Texas, to-wit: -In the a~ey between ''rd S~reet and 34th S+reet a nd ATenue U and Avenue V. SECTION z. The City Manager is authorized and directed to cause the placing of signs so as to clearly define the limits of the prima facie areas set out in this ordinance. SECTION 3. Any person, firm or corporation violating the prima facie speed limit established by this Ordinance shall upon conviction be fined in any sum not to exceed TWO HUNDRED DOLLARS ($ZOO. 00) and for subsequent violations within one year th~re­ after shall be prosecuted as prescribed for such violations by Section 15 of Ar1ticle 8Z7a, V~rnon's Annotated Penal Code. · SECTION 4. The City Secretary is authorized and directed to cause the publica- tion of the descriptive caption of this Ordinance together with the penalty provision as an alternative method of publication as provided by law. SECTION 5. The fact that public necessity and convenience requires that this Ordinance be passed as an emergency measure for reasons set forth in the preamble hereof., the rule requiring that no Ordinance shall be finally passed on the day of its introduction be suspended, and this Ordinance is declared to be an emergency measure to take effect from and after its passage.
