Y\ THIS ORDINANCE SUBJECT TO THE FOLLOWING CONDITION; {1) THAT A 35
. ~ FOOT BUILDING SETBACK LINE BE REQUIRED ALONG THE EAST RIGHT-OF--x: WAY UNE OF GARY AVENUE, FOR THE DEVELOPMENT PLACED ON THE
(A' NORTHWEST CORNER OF TRACT A, MONTEREY CENTER ADDITION; AND
1PROVIDING THAT THE UNCANCELLED PORTIONS OF SAID BUILDING SETBAC

, WHEREAS, certain changes have been proposed by the owners in Zone !t ICase No. 701 as regards building setback lines which were required as c<;"nditions

/, ,-.--. <:7 City of Lubbock, and said proposals were duly presented to the Planning and

Zoning Commission for its recommendation, which recommendation was received
by the City Commission and after due consideration, the City Commission finds
that making the proposed change as hereinafter set out will be in the public interest
and,
WHEREAS, all conditions precedent required by law for a valid amend~n t
to the Zoning Ordinance and Map have been fully complied with, as well as giving
notices in compliance with Section 20 of Ordinance No. 1695. as well as notices
provided J>y Artie le 10 llf," Vernon r s Annotated Civil Statutes, amended in 19 53
and notice was duly published in the Lubbock Morning Avalanche more than fifteen
(15) days p_rior to the date of the public hearing according to said notice was duly
held i~ the City Commission Room on the first floor of the City Hall, Lubbock,
Texas, at which time persons appeared in support of the proposal; ana, after said
public hearing, it was by tJ:te City Commission determined that it would be in the
public interest, due to changed conditions, that the Zoning Ordinance and Zoning
Map be amended in the manner hereinafter set forth in the body of this Ordinance
and this Ordinance having been introduced in final written form prior to first
reading hereof; NOW, THEREFORE,
BE IT ORDAlNED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. THAT the 200-foot building setback lines for vehicular parking
required as a condition for zone change by Ordinances 2215 and 2183 of the City
of Lubbock are hereby cancelled insofar as said building setback lines affect the
following described tracts of land, said tracts being designated as Tract 1 and
Tract 2, to-wit:

TRACT 1: BEGINNING at a point, said point being the North-
weSt-corner of Tract A, Monterey Center Addition to the City
of Lubbock, Lubbock County, Texas;
THENCE East 150 feet to a point;
THENCE South 150 feet to a point;
THENCE West 150 feet to a point;
THENCE North 150 feet to the PLACE OF BEGINNING.
TRACT 2: BEGINNING at a point, said point being the North-
east corner of Tract A,· Monterey Center Addition to the City
of Lubbock, Lubbock County, Texas; -
THENCE West 150 feet to a point;
THENCE South 150' feet to a point;
THENCE East 150 feet to a point;
THENCE North 150 feet to the PLACE OF BEGINNING.
Said cancellation is hereby made subject to the following condition:
(1) That a 35 foot building setback line be required along the East right-of•
ay line of Gary Avenue, for the development placed on the Northwest corner of
Tract A, Monterey Center Addition.
SECTION 2. The 200-foot building setback line required by Ordinances
2183 and 22.15 of the City of Lubbock shall remain in full force and effect except
he portions thereof which are cancelled by Section 1 of this Ordinance.
AND IT IS SO ORDERED.
