HomeMy WebLinkAboutOrdinance - 2582-1958 - Amending Sec 2-1 Of Lubbock City Code - 09/11/1958AN ORDINANCE AMENDING SECTION Z-1 OF THE LUBBOCK CITY CODE CONCERNING HOLIDAYS FOR ALL PERMANENT CITY EMPLOYEES AND CHANGING THE OBSERVANCE OF THANKSGIVING DAY TO THE FOURTH THURSDAY IN NOVEMBER: PROVIDING AN EFFECTIVE DATE AND DECLARIN AN EMERGENCY .. · WHEREA~ the City Commission finds that there has been much confusion as to the proper day on which to observe Thanksgiving as a holiday; and WHEREAS, the State Legislature has recently attempted to remedy much of said confusion by designating the fourth Thursday in November as Thanksgiving Day; and WHEREAS, the existing Section Z-1 of the Lubbock City Code designates the last Thursday in November as Thanksgiving Day and is thus in conflict with state law., and should be immediately amended to remove such conflict; and WHEREAS. the publication date of the new Lubbock City Code is imminent and it is imperative that the conflict between Section Z-1 aiXi the state law be removed prior to said publication date; and WHEJU:AS, the Lubbock City Code, which. controls and governs the usual dail~ operations of the City departments, must contain an accurate and valid codificatio~ of the intent and decree of the City Commission within the limits of state law., creates an emergency; NOW,, THEREFORE: BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Section Z-1 of the Lubbock City Code be amended to read he.t:eafter as follows, to-wit: Sec. Z-1 Holidays for city employees---Gene rally. The following days are hereby declared holidays for all permanent city employees, subject, however:. to limitations herein stated. 1. The first day of January--New Year's. z. The Thirtieth day of May--Memorial Day. 3. The Fourth day of July--Independence Day. 4. The First Monday in September~-Labor Day .. 5. The Fourth Thursday in November--Thanksgiving Day. 6. The Twenty-fifth day of December--Christmas Day. 7. Any other holiday designated by the city commission. 8. When any holiday li.sted above. falls on-J)unday., the following business day shall be considered as a holiday. The designation of the foregoing day~ as holidays shall not be construed as entitling any such employee to observe such holiday, or the right to be absent from his duty on the dates specified, exc~pt as provided in the following section. SECTION 2. Due to the fact that this Ordinance deals with a subject directly and indirectly affecting the daily operation of the City departments, all rules' requiring the passage of an ordinance by more than one reading are hereby suspended and this Ordinance is declared to be an emergency measure; and the sanle shall become effective on the date of its passage.
