Meat And Meat Products - 07/24/1958" AN ORDINANCE AMENDING SECTION 13-32., DIVISION 1, ARTICLE 3, LUBBOCK CITY CODE PERTAINING TO 11MEAT AND MEAT PRODUCTS", MAK1NG AN EXCEPTION TO THE TERMS OF THIS ARTICLE BY PROVIDING FOR INSPECTION OF MEATS SLAUGHTERED AND INSPECTED UNDER SUPER VISION OF AN OFFICIAL MEAT OR FOOD INSPECTOR OF ANY CITY IN THIS STATE IN WffiCH THE INSPECTION OF MEAT AND MEAT PRODUCTS HAS BEEN APPROVED BY LUBBOCK CITY HEALTH DEPARTMENT; AND ADDING A NEW SECTION TO SAID ARTICLE 3 NUMBERED AND DESIGNATED AS SECTION 13-2.7.1 PROVIDING AUTHORITY AND EMPOWERING CITY MEAT INSPECTOR TO APPROVE, NAME AND DESIGNATE LAY-MEAT INSPECTORS; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY DISPENS- ING WITH NECESSITY OF READING ON. TWO SEPARATE OCCASIONS THIS ORDINANCE AND THEREBY MAKING THE TERMS HEREOF EFFECTIVE IMMEDIATELY UPON PASSAGE. WHEREAS, the City Health Department has called attention to and requested the City Commission to clarify Section 13-32. of Article 3 of the Lubbock City Code in order that the Health Department of the City of Lubbock have more control of the inspection of meat or meat products manufactured in whole or in part from the meat of any animal slaughtered and produced outside of the corporate limits of the City of Lubbock; and, WHEREAS, the City Commission finds that it is desirable for the pro- tection of the health and welfare of the inhabitants of the City of Lubbock that the Health Department have the necessary control of inspection of such meat and meat products manufactured in whole or in part from the meat of any animal slaughtered and produced outside the City Limits. of the City of Lubbock; and, WHEREAS, it appears further to the City Commission that there is no present authority for the approval, naming and designation of lay-meat inspectors by the Health Department; and, WHEREAS, it is deemed necessary and expedient that the Health Department acting through the City Meat Inspector, approve, name and designate lay-meat inspectors in order that the public health and welfare of the residents of the City of Lubbock be preserved; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 13-32, Article 3, 11Meat and Meat Products" of the Lubbock City Code BE and the same is hereby amended to read as follows: "Sec. 13-32.. Animals must have been slaughtered and inspected under supervision of health department; exceptions. It shall be unlawful for any person to have, keep;, sell or expose for sale or have in his possession with intent to sell for human food, within the limits of the City, the meat or food products manufactured in whole or in part from the meat of any animal, unless the same shall have been inspected and slaughtered under the supervision of the health department of the city, in accordance with the. provisions of this article; provided, however, that this article shall not apply to the meat or food products manufactured from the meat of animals slaughtered and inspected under the supervision of the United States Govern- ment in accordance with the regulations relating to the inspection of meat as prescribed by the Department of Agriculture and bearing the stamp of such inspectio~ or to any such meats slaughter ed and inspected under the supervision of an official meat or food inspector of any city in this state in which the inspection of meat has been approved by the health department of this city, and bear- ing the stamp showing that such meat has been inspected and passed by the meat or food inspector of such other city. u SECTION 2. THAT Article 3, 11Meat and Meat Products" of the Lubbock City Code BE amended by adding thereto the following to be designated as Section 13-27.1, which is: "Sec. 13-27. 1 Lay-meat inspector ... Approved, named and designated by City Meat Inspector. . The Chief Meat Inspector of the City of Lubbock is here by authorized and empowered, upon written application, to approve, name and designate lay-meat inspectors, who in his opinion are qualified by training and experience, to assist him or any veterinary meat inspector duly appointed by any other city, and acting outside the City of Lubbock in ante-mortem and post mortem inspections; supervise , the curing, canning, packing and other preparation, handling, marking and labeling of products, and examine such articles to detect unsound or unfit conditions, enforce sahita,ry requirements and perform various oth.er duties to further aid in carrying out the intention purpose and provisions of this article. u SECTION 3. If any section, sub-section, sentence, clause, phrase or portion of this Ordinance .for any reason is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be dee:t;ned a separate, distinct and independent provision and such hllding shall not affect the remaining portion ·:hereof. SECTION 4. The fact that the immediate preservation of the public health and safety of the residents of the City of Lubbock requires that this Ordinance be passed as an emergency measure as more particularly shown by the findings set forth in the preamble hereof, the rule requiring that no ordinance shall be finally passed on the day of its introduction BE and is hereby suspended and this Ordinance is declared to be an emergency measure to take effect immedi ately upon, from and after its passage.
