AN ORDINANCE AMENDING ZONING ORDINANCE. NO. 1695 AND THE
OFFICIAL MAP OF THE CITY. OF LUBBOCK SO AS TO MAKE THE FOLLOW-
ING CHANGE: ZONE CASE NO. 690 -CHANGE AN AREA SOUTH OF 50TH
STREET AND WEST-OFAYENUE-UIN THE CITY OF LUBBOCK, TEXAS,
FROM AN "R-1" TO A "C-2" ZONING DISTRICT; SUBJECT TO THE FOLLOW-
ING CONDITIONS: 1. THAT A SOLID SEVEN FOOT VISUAL SCREENING
FENCE OR WALL, OF MASONRY CONSTRUCTION OR THE EQUIVALENT,
BE PLACED ALONG THE 51ST STREET SIDE OF THE PROPERTY AND ALONG
THE AVENUE V SIDE OF THE PROPERTY TO THE BUILDING LINE, AT THE
TIME OF DEVELOPMENT. 2. THAT A PLANTING SCREEN BE PLACED IN
CONJUNCTION WITH THE SCREENING WALL OR FENCE REQUIRED IN CON-
DITION NO. t ABOVE. 3. THAT THE AREA BE DEVELOPED AS A UNIT.
4. THAT THE BUILDING SETBACK SHALL BE DETERMINED WHEN THE
PROPERTY IS PLATTED, AND NO BUI_LDING PERMIT IS TO BE ~SSUED UNTIL
THE PROPERTY IS PLATTED.
WHEREAS, the proposed change in zoning districts as hereinafter made
has been duly presented to the Zoning and Planning Commission for its recom-
mendation, which was received by the City Commission and after due considera·
tion, the City Commission finds that making the proposed change as hereinafter
set out will be in the public interest; and,
I WHEREAS, all conditions precedent required by law for a valid amend-
lment to the Zoning Ordinance and Map have been fully complied with, as well
as giving notices in compliance with Section 20 of Ordinance No. 1695, as well
as notices provided by Article lOllf, Vernon's Annotated Civil Statutes, amended
in 1953 and notice was duly published in the Lubbock Morning Avalanche more
I t~n ~ifteen (15) days prior to the date of the public .hearin~ before the City Com-
mlSSlon on such proposed amendment, and the public hear1ng according to said
notice was duly held in the City Commission Room on the first floor of the City
Hall, Lubbock, Texas, at which time persons appeared in support of the proposal;
and, after said public hearing, it was by the City Commission determined that it
would be in the public interest, due to changed conditions, that the Zoning Ordin-
ance and Zoning Map be amended in the manner hereinafter set forth in the body
of this Ordinance and this Ordinance having been introduced in final written form
1 prior to first reading hereof; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: .
SECTION 1. THAT Ordinance No. 1695 and the Official Zoning Map BE
and the same are hereby amended as follows, to-wit~
ZONE CASE NO. 690 -----------------
Change the following described property in the City of Lubbock,
Lubbock County, Texas, from an "R-1" to a ttC-2" zoning district:
BEGINNING 45 feet South and 30 feet West of the
Northeast corner of the Northwest quarter of Section 3*
Block E, Lubbock County, Texas;
THENCE West 630 feet;
THENCE South 285 feet;
THENCE East 630 feet;
THENCE North 285 feet to the PlACE OF BEGINNING
(Vicinity of 50th Street and Avenue U);
subject to the following conditions:
1. That a solid seven foot visual screening fence or wall,
of masonry construction or the equivalent, be placed
along the 51st Street side of the property and along ihe
Avenue V side of the property to the building line, at
the time of development.
?.. That a planting screen be placed in conjunction with the
screening wall or fence required in Condition No. 11111 above.
3. That the area be developed as a unit.
4. That the building setback shall be determined when the property
is platted, and no building permit is to be issued until the
property is platted.
SECTION 2. THAT from and after passage and effective date of this
Ordinance, said lots, tracts and parcels of land described in Section 1 hereof,
shall be changed to the Zoning District indicated and the Official Map is amended
in accordance herewith.
AND IT IS SO ORDERED.
