BLOCK 1 OF G:R"AN'VlLLEJOllN'SON SUBDIVISION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY 7 TEXAS, FROM UR-3" TO "C-3" ZONING DISTRICT; SUBJECT TO THE FOLLOWING CONDITIONS: (1} THAT A TWENTY TWO (~2.} FOOT UTILITY EASEMENT FOR ALL PUBUC UTIUTIES BE GRANTED PARALLEL TO AND ABUTTING 35TH STREET ACROSS LOTS 9 THROUGH 16, BLOCK 1, GRANVILLE JOHNSON SUBDIVISION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS; {2) THAT A SOUD SEVEN FOOT SCREENING WALL OF MASONRY CONSTRUCTION OR ITS EQUIVALENT BE PLACED ADJACENT TO AND PARALLEL WITH 35TH STREET ACROSS LOTS 11 THROUGH 16, BLOCK 1, GRANVILLE JOHNSON SUBDIVISION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY 7 TEXAS, SAID WALL TO BE CONSTRUCTE WITIDN THE SOUTH THREE {3) FEET OF SAID LOTS 11 THROUGH 16. SAID FENCE SHALL BE REDUCED IN HEIGHT ON LOT 16 TO PROVIDE ADEQUATE VISUAL CLEARANCE FOR THE INTERSECTION OF 35TH STREET AND AVENUE P. NO BUILDING PERMIT SHALL BE ISSUED PRIOR TO THE CON- . STRUCTION OF SAID FENCE. {3} THAT A 19 FOOT PAVED SERVICE DRIVE BE CONSTRUCTED; SAID SERVICE DRIVE TO BE CONSTRUCTED ACROSS SAID LOTS 11 THROUGH 16 ADJACENT AND ABUTTING THE NORTH SIDE , OF THE THREE (3} FOOT STRIP DESCRIBED IN CONDITION 2 ABOVE. WHEREAS., the proposed change in zoning districts as hereinafter made· has been duly presented to the Zoning and Planning Commission for its recom- mendation, which was received by the City Commission and after due considera- tion, the City Commission finds that making the proposed change as hereinafter set out will be in the public interest; and, WHEREAS, all conditions precedent required by law for a valid amend- ment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernon's Annotated Civil Statutes, amended in 1953, and notice was duly published in the Lubbock Morning Avalanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on such proposed amendment, and the public hearing according to said notice was duly held in the City Commission Room on the first floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and, after said hearing, it was by the City Commission determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance; and this : Ordinance having been introduced in final written form prior to first reading hereof; NOW THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT .. Ordinance No. 1695 and the Official Zoning Map BE and the same are hereby amended as follows, to-wit: ZONE CASE NO. 613 Change Lots 11, 12., 13;-and'I4-;"-Bi'OCk-re>rGranville Johnson Subdivision to the City of Lubbock, Lubbock County, Texas, from 11R-3" to nc-3u Zoning District; SUBJECT TO THE FOLLOWING CONDITIONS: v (1) That a twenty-two (22) foot utility easement for all public utilities be granted parallel to and abutting 35th Street across Lots 9 through 16, Block 1, Granville Johnson Subdivision to the City of Lubbock, Lubbock County, Texas; (2) That a solid seven foot screening wall of masonry construction or its equivale t be placed adjacent to and parallel with 35th Street across Lots 11 through 16, Block 1, Granville Johnson Subdivision to the City of Lubbock, Lubbock County, Texas, said wall to be constructed within the South three (3} feet of said Lots 11 through 16. Said fence shall be reduced in height on Lot 16 to provide adequate visual clearance for the intersection of 35th Street and Avenue P. No building permit shall be issued prior to the construction of said fence. (3) That a 19-foot paved service drive be constructed; said service drive to be constructed across said Lots 11 through 16 adjacent and abutting the North side of the 3-foot strip described in Condition 2 above. SECTION 2. THAT from and after passage and effective date of this Ordinance, said lots, tracts and parcels of land described in Section 1 he ~eof . shall be changed to the zoning district indicated and the Official Map is amen~d in accordance herewith. AND IT IS SO ORDERED.
