AND THE DUTY OF THE OWNER OR OCCUPANT OF PREMISES, OMITTING THE SEASONAL UMITATION ON THE OPERATION OF THESE SECTIONS; DECLAR- ING AN EMERGENCY; 'AND PROVIDING FOR PUBLICATION. WHEREAS, the City Commission finds that weeds growing to a · height of more than twelve inches on an average and growing in rank profusion are a fire hazard and a menace to public health in that they contaminate the atmosphere "th substances which cause or aggravate allergic conditions and asthma and thus constitute a nuisance throughout the year; and, WHEREAS, the Lubbock City Code at present provides for the control of weeds during only a portion of the year; and, WHEREAS, the City Commission finds that an emergency has arisen which requires immediate control of weeds, grass, etc.; THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 12-3 of the Lubbock City Code be amended to read as follows, to-wit: "Sec. 12-3. Control of weeds, grass, e.tc. ·-Generally. It shall be unlawful for any person to suffer or permit weeds, grass, or plants that are not cultivated to grow upon any premises to a height of more than twelve inches on an average and to grow in rank profusion thereon, and any such premises upon which any weeds, grass or plants are permitted to grow above the height of twelve inches or in rank profusion shall be de.emed a nuisance as dangerous to public health and calculated to increase the fire hazard of the city. Such nuisance shall be subject to abatement as provided for in Sections 15-29 to 15-34 of this Code. 11 SECTION 2. THAT Section 12-4 of the Lubbock City Code be amended to ·read as follows, to-wit: 11Sec. 12-4. Same -Duty of owner of premises. It shall be the duty of the owner or occupant of any premises to remove or cause to be cut all weeds, grass and plants that are not cultivated as often as may be necessary to comply with the preceding section and to use every precaution to prevent such weeds, grass or plants growing on such premises so as to become a nuisance as defined in that se.ction. The removing and cutting of weeds, grass and plants which are not cultivated, at least once in three weeks shall be deemed to be in compliance with this Section. tt SECTION 3. Weeds growing to a height of more than twelve inches or in rank profusion create a danger to public health and are calculated to increase the fire hazard of the City creating a. public necessity requiring all rules that no ordinance shall be finally passed on the date of its introduction be suspended; and this Ordinance is declared to be an emergency measure to take effect from and after its first publication. SECTION 4. The City Secretary is hereby directed to cause the publication of this Ordinance once a week for t·wo consecutive weeks in the official publication of the City of Lubbock.
