AN o'RDINANCE AMENDING CHAPTER 18, ARTICLE VII, SE;:CTION 18-102 ENTITLED "IMPOUNDING OF ILLEGALLY PARKED OR ABANDONED VEHICLEStt; AND INCREASING THE IMPOUNDING FEE TO THE SUM OF FOUR DOLLARS ($4. 00); AND DECLARING AN EMERGENCY. WHEREAS, the Commission finds that the impounding fee now assessed is unsufficient to defray the cost of impounding; and public necessity and con- venience requires the immediate increase of such impounding fee creating an emergency affecting a Department of the City; THEREFORE, · BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1 •. Chapter 18, Article VII, Section 18-IOZ of the Lubbock City Code is hereby amended to read as follows: "Sec. 18 -102. Impounding of illegally parked or abandoned vehicles. Any vehicle parked on any public street, or in an alley, or in front of a fire hydrant, or on any part of a crosswalk, or in any loading zone in violation of any provision of this chapter or other ordinance of the city or statute of the state, or abandoned on any _public street, may, upon direction of the chief of police, be removed from such place, impounded and taken to such place as is designated by the traffic division of the police department, and an impounding fee of four dollars ($4. 00) plus storage shall be assessed against such vehicles, and the owner or driver thereof, and collected before such vehicle is released. A storage fee of fifty cents for each twenty-four hours su::h vehicle is impounded is hereby assessed against each such vehicle and the owner, and the same shall be collected before such vehicle ~s released. The payment of the impounding fee shall not constitute a defense to any charge against the driver or owner of &ch vehicle for violating this chapter or other traffic ordinances prohibiting or limiting such parking. The fees herein provided for shall be charged and collected by the city recorder and accounted for, and such sums as may be collected shall be used to defray the expense of impounding and . transporting such impounded vehicles. (Ord. No. 1367, Sec. 2)" SECTION 2. The fact that there is an immediate need to increase the impounding fee as set out in the preamble of this Ordinance creates an emergenc affecting the daily operation of a Department and requires the suspension of all rules relating to the reading of ordinances on more than one day and the same are hereby suspended and this Ordinance shall become final and effective on the date of its approval and passage as an emergency measure. AND IT IS SO ORDERED. Passed by unanimous vote of the Commission this 27th day of March, 1958.
