'2427 0'3 -\~-1..958 AN ORDINANCE AMENDING CHAPTER 12, SECTION 12. 21 OF THE I LUBBOCK CITY CODE BY MAKING AND DECLARING .ALL PREMISES UNDER THE SUPERVISION OF THE AIRPORT BOARD OF THE CITY OF LUBBOCK TO BE WITHIN A FIRE PREVENTION ZONE OF THE CITY OF LUBBOCK AND EXTENDING Tf{E JURISDICTION OF THE ClfiEF OF THE FIRE DEPARTMENT AND FIRE MARSHALL TO INCLUDE THE FIRE PREVENTION ZONE HEREBY ESTABLISHED!. AND MAKING ALL OF THE PREMISES WITIDN SAID FIRE ZONE SUBJECT TO ALL APPLICABLE FIRE PROTECTION AND FIRE PREVENTION ORDINANCES AND PROVISIONS OF CHAPTER 12 OF THE LUBBOCK CITY CODE AND ALL AMENDMENTS CUMULATIVE WITH THE TERMS OF THE ORDINANCE; PROVIDING A PENALTY. WHEREAS, the City Commission finds the premises of the Municipal Air- port and land under the supervision and control of the .Airport Board of the City of Lubbock should be included within the Fire Prevention Zones established by the City of Lubbock for the purpose of eliminating any dangerous fire hazards and lessen the threat to public safety, NOW THEREFORE: ' BE IT ORm1NED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: I Chapter 12; Sec~ion.. 21 of the Lubbock City Code is hereby amended by adding Sections 12-21. 14 to Section 12-21. 17 inclusive reading as follows: SECTION 12-21. 14 MUNICIPAL AIRPORT FIRE PREVENTION ZONE CREATED The Municipal Airport and all pt:emises within the jurisdiction;) control and supervision of the Airport Board of the City of Lubbock is hereby declared to 1 be a 11fire prevention zonen and shall be designated as the ttMunicipal Airport Fire Prevention Zone11• SECTION 12-21. 15 JURISDICTION -CIDEF OF FIRE DEPARTMENT AND FIRE MARSHALL EXTENDED The respective jurisdiction of the Chief of the Fire Department and Fire Marshall of the City of Lubbock shall be and is hereby extended to the 11Munici- pal Airport Fire Preve.ntion Zone" within the terms and application of the entire Chapter 12 of the Lubbock City Code and all amendments thereto. SECTION 12-21. 16 ALL ORDINANCE , PROVISIONS RESPECTING FIRE PROTECTION AND FIRE PREVENTION MADE CUMULATIVE All ordinances and parts of ordinances pertaining to Fire Protection and Fire Prevention7 and particularly all sections of Chapter 12 of the Lubbock City Code and am~ndments which may be applicable shall be and are hereby made cwnulative with the terms of this ordinance and are extended to and include the Municipal Airport Fire Prevention Zone. SECTION 12-21. 17 PENALTY. Any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof in the Corporation Co~rt of the City of Lubbock7 shall be fined in any sum not exceeding TWO HUNDRED DOLLARS. BLACK laae or Xnapec·tor ORDINANCE NO o 2297 AN ORDINANCE AMnmiNG THE WBBOCK CITY CODE BY PROVIDING FIRE PREVENTION ;oN18 WITHIN THE CORPORATE LIMITS OF THE CITY~ DEFINING DANGEROUS A.CCUMUL4TIONS; PROVIDING FOR PERIODICAL INSPECTIONS FOR DANGmOUS ACCUMULATIONS AND NOTICES TO OCCUMPANTS 9 0\iNmS AND OTHmS HAVING AN IN'l'FlUST IN SUCH PREMISES; PROVIDING FOR RDI>VAL OF FIRE HAZARDS~ PROVIDING FOR APPEAlS AFTFlt NOTIC!a: Dil}IARING TllE EXIST- ENCE OF DANGDl.OUS ACCUMUlATIONS AND OTHm FIRE HAZARDS TO BE Nt1ISANCl!S 1 AUTHORIZ- ING THE CI.flSING OF BUILDINGS AND OTHm STRUCTIJRES CONSTITUTING DANGIROUS FIRE HAZARDS~ PROVIDING FOR VACATION OF BUILDINGS CONSTITUTING DANGPIWUS FIRE HAZARDS; PROVIDING CI!RTAIN EXCEPTIONS FOR RESID»iTIAL STRUCTURES CONSTITUfiNG DANGm«lUS FIRE HAZARDS TO THE OCCUPANTS~ PROVIDING PENALTIES~ AUTHORIZING SUITS IN AID OF ENFORCF.MENT9 AND MAKING PROVISIONS OF THE ORDINANCE CUMULATIVEo WHEREAS 9 the City Ccmmission finds that in some parts of the City 'the occupants or owners of property have permitted dangerous accUJllDlations to exist on various tracts of land and have further permitted buildings and other struc- tures to remain in such state of disrepair that the same constitute dangerous fire hazards and a threat to public safety~' and further find that existing or- dinances are inadequate to provide inspections and require the elimination of such hazards; TWilmOFORE9 / u I BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: Chapter 129 Section 21 of the Lubbock Ci-ty Code is hereby amended by adding Sections 12-2lol to Section 12=2lol3 inclusive reading as follows~ SmTION 12-2lol INSPECTION BY FIRE MARSHALL It sball be the duty of the Fire Marshall to inspect as often as may be nessary, but not less than twice a year 9 all buildings and. premises, except the interiors of living quarters and private dwellings.~> for the purpose of ascertaining and causing to be corrected any coruli tions liable to cause fire, or to ascertain and discover any violations of the provisions or intent of this Article or any law or ordinance affecting the fire hazardo DANGEROUS ACCUMULATIONS -DEFINITION For the purpose of this Article the term "dangerous accumulationsn is defined as follows& "Any building or structure upon any lot.~> tract, parcel of land or premises of any kind containing or havi~ituated thereon any combustible or explosive matter9 substance or materials such as, but not limited tog dilapidated sheds9 dilapidated buildings, dilapidated structures9 crates9 staves9 barrels9 boxes, cloth9 dis-. carded or abandoned clothing8 rags9 upholstery, grass, brush, straw; bay, weeds 9 scrap lumber, una tacked lumber, kindling, broken timber, · shaviugs8 shelving, planks9 debris9 waste paper9 litter, trash9 junk, refuse materials or other inflammable materials or any combination thereof calculated to be a fire ha£ard to persons or property, or to increase the fire hazard o11 SECTION l.2c-2lo3 NOTICE BY FIRE CHIEF 9 FIRE MARSHALL Whenever the Chief of the Fire Deyartment or Fire Marshall9 after inspection of any building or structure or premises in the City of Lubbock finds, because of deterioration9 age9 lack or repairs9 or having therein or thereon electrical rires or equipnent impropetrly installed9 electric wiring or equipnent out of repair 9 def t!!Cti ve chimneys 9 defective gas con- nections D or appliances 9 defective h®ating apparatus 9 inadequate means of exit9 or ndarJ8erous accumulations" (as that term is defined in this article), or any other cause9 all or any part of which conditiQns present a fire hazard or render said buildings9 structures or premises liable to fire, or '!hich buildings or structures or premise3 are so situated or occupied9 or in such condition or disorder or disrepair 9 either from the exterior or interior 9 as to endanger said building~ structures or premises or buildings 9 structures or premises or property located elsewhere9 or human life9 from a fire in or on mch building9 structure or premises9 the Chief of the Fire Department or Fire Marshall shall cause to be served ~tten notice on the owner9 or occupant~ or person responsible therefor9 to remove such fire hazard by rearranging, repairing or wrecking the condemnil!d buildings or structures~ or by repairing the equipnent therein or by changing the occupancy therein or by clearing the premises of "dangerous accumulationsn (as that term is defined in this article) in such a way as to remove said fire hazard o Page 'l'Wo ( I,_~.... ' .... :=; ~ ; "' .. ) ... - SJOOTION 12-2lo4 FIRE PREVENTION ZONES -INSP.F£TIONS It shall be the duty of the Chief of the Fire Department and the Fire Marshall jointly to for~ith plat the City into "fire prevention sones" each containing a City Fire Station,~~ and submit such plat to the City Manager for approvalo Upon approval of said plat by the City Manager as submitted or as modified by him, it shall be the duty of the Chief of the Fire Department to cause inspection of all premises in each "fire prevention sone" at least twice a year by members of the Fire Department employed in each sone o Such inspections to be made by uniformed firemen at the tiDe and in the manner designated and directed by the Chief of the Fire Departmento Such inspections ahall be made by carefully viewing all preai- ses in each sone both from the abutting street and abutt!Dg alley o The Chief of the Fire Department shall require such written reports frCID inapect.tnc firemen as will disclose ndangerous accumulations., as that term is defined in this article o SEX:TION l2-2lo5 IUMOVAL OF HAZARDS -NOTICE-APPEAlS The Chief of the Fire Department or Fire Marshall ahall in such written notice fix the time within which said owner, occupant or person responsible therefor shall remove said huard or make said repairs i or clear the premises of naangerous acCUDJ- lations" specified in the noticeo In no case aball the time fixed be leas thaD ten (10) days o Should the owner or person responsible therefor, or the owner or person responsible for the condition of the building9 structure or premises reside out- aide the City of Lubbock and the address be w:aknown 9 a notice or publication 111 a daily newspaper in the City of Lubbock and the posting of a written notice on the building or at.rocture or premises shall be deemed sufficient noticeo The Giller, occupant or person respOMible ther~for£> ·~ithin ten (10) days after receiring said notice 9 may appeal in wri tiDg from the order of the Chief of the Fire Department or Fire Marshall to the City Manager who shall determine the appeal o Su:TION 1.2-2lo6 FAILURE TO COMPI.I .... CLOSING BUILDINGS If the owner or person reap~sibl~ for the condition of such building or struc- ture or premises9 whether res ident or non=resident of the City of Lubbock fails to ccaply with the order of the Chief of t he Fire Department or Fire Marshall., to remove the hazardous fire condition in ~r on the building or structure or on the lot., tract or parcel of laad or premises where s uch hazard exists 9 as directed by the Chief ot the Fire Department or Fire Marshall9 the City Ma.na&er may order the Chief of the Fire Department or Fire Marshall to abate the use of non-residential buildings or structures 9 and to that end the Chief of the Fire Department or Fire Marshall shall have authority to close said non.,;resid•tial buildings or structures and to prevent its use or occupancy until the order of the Chief of the Fire Department or Fire Marshall has been complied witho Page Three S1!£TION ~loS FAILURE TO COMPLY ~ PENALTY ~ VACATING BUILDINGS In addition to the penalty herein imposed of closing any such building or structure it shall be \D1la.wtul for any person to disobey 9 or fail to comply vi th the order of the Chief of the Fire Department or Fire Marshall or to use 1 occupy or remain in any such non=residential building or structure 1 when the aaae has been ordered closed9 or to remain upon 9 or uae J~ or pemit the use of any such premises with "dangerous accumulations• located thereono SJ!XlTION 12-21 o9 R§IDENTIAL BUILDINGS -E1CEHION When Illy b•d]ding or structure is occupied or ued for residential purposes8 T&Cation of the building9 residence or structure shall not be ordered by notices under this article unless such vacation is specially ordered by the governing 'bod.yo SECTIPN 12=2lol0 FAILURE TO COMPLY ...
