HomeMy WebLinkAboutOrdinance - 2420-1958 - Increasing Prima Facie Speed Limits From 30 To 55 MPH. - 02/27/1958=-:;~ 1~====================-0 ~ -~ + -1.9 S<jl-=#== JWF:gb~ ORDINANCE NO. 2420 2./18/581 AN ORDINANCE AUTHORIZING AND INCREASING THE PRIMA FACIE SPEED LIMITS FROM 3 0 MILES PER HOUR to 55 MILES PER HOUR ON THOSE PORTIONS OF STREETS AS HEREAFTER DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE TRAFFIC ENGINEER TO PLACE SPEED l.lMIT SIGNS SO AS TO CLEARLY DEFINE THE UMITS OF THE PRIMA FACIE AREAS SET OUT IN THIS ORDINANCE; PRESCRIBING A PENALTY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGEN AND THE EFFECTIVE DATE OF THIS ORDINANCE. WHEREAS, the governing body of the City of Lubbock has determined upon the basis of an engineering and traffic investigation that the prima facie speed limits set forth and established by Article 827a, Section 8, Vernonrs Annotated Penal Code, as amended by Acts of 1951, 52.d Leg., P. 589, Ch. 346, Sub- Sec. 1, are less than is reasonable or safe under the conditions found to exist upon certain highways, streets and/or parts of highways and streets at the locations named and designated in the body of this Ordinance and in the corporate limits of the City of Lubbock, taking into consideration the width and condition of the pavement and other circumstances on such certain highways, streets andj. parts of highways and streets, as well as the usual traffic thereon; and, WHEREAS, it is necessary for the immediate preservation of the public health and safety to provide for the immediate enactment of such measures, constituting an emergency; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION QF THE CITY OF LUBBOCK: SECTION l. THAT from and after the effective date of this Ordinance the prima-facie speed limit established by Article 827a, Section 8, Sub-Sec. 1 (B) {1} Vernon's Annotated Penal Code, as amended by Acts 1951, 52nd Leg., p. 589, Ch. 346, Sub-Sec. 1, is altered and changed for all vehicles to fift -five 55 miles er hour on the following designated highways or streets 1n e corpora e m1 s of theCity of Lubbock, to-wit: ·o·' 'IJ'I· <,..... r, '<It>'-"· ~~._ I (A) On .!~~uth Si!!_~~f ~:..~ ~ghw!.Y_ 84, beginning 600 feet 'S'outheasiOttlie traH1c ctrCie on T."S. Said Traffic Circle referred to in Subsections l(A) and 1{13) above being the Traffic Circle where Avenues 11A 11, "H", and 110 11 intersect and/or come together in the southern portion of the City of Lubbock, Texas. SECTION 2.. The Traffic Engineer is authorized and directed to place speed limits signs so as to clearly define the limits of the prima-facie areas set forth in Section 1 of this Ordinance. SECTION 3. Any violation of the prima-facie speed lirhits established I by this Ordinance by any person, firm or corporation shall be unlawful and shall constitute a violation as provided by Section 8 of Article 827a, as amended,. I Vernonts Annotated Penal Code, and upon conviction such person, firm or corporation shall be punished by a fine of not more than Two Hundred Dollars ($200. 00} and for subsequent violations within one year thereafter such person shall be prosecuted as prescribed for such violations by Section 15 of Art. 827a, Vernon's Annotated Penal Code. u SECTION 4. The City Secretary is hereby authorized and directed to publish this Ordinance once a week for two {2) consecutive weeks in a newspaper regularly published in the City of Lubbock. SECTION 5. The fact that the heavy flow of vehicular traffic through the several highways and streets as herein designated and established as a hazard, dangerous to the safety of persons and property, creates a public necessity requiring all rules that no ordinance shall be finally passed on the day of its introduction be suspended; and this Ordinance is declared to be an emergency measure, to take effect from and after its passage.
