ORDINANCE NO. 24I9
AN ORDINANCE EXTENDING AND OPENING TOLEDO AVENUE
SOUTH AT ITS INTERSECTION WITH THE PANHANDLE AND SANTA FE
RAILWAY COMPANY RIGHT OF WAY; REQUESTING A GRADE CROSSING
FOR PEDESTRIAN AND VEHICULAR TRAFFIC; PROVIDING FOR USUAL
AND CUSTOMARY WARNING AND SAFETY DEVICES AT SUCH STREET
INTERSECTIONS WITH RAILROAD GRADE CROSSING; AUTHORIZING THE
CITY SECRETARY TO PUBUSH THE DESCRIPTIVE CAPTION OF THIS
ORDINANCE AS PROVIDED BY lAW; DEClARING AN EMERGENCY AND
PROVIDING THAT THE TERMS OF THIS ORDINANCE BECOME EFFECTIVE
IMMEDIATELY UPON PASSAGE ON FIRST READING.
WHEREAS, public necessity and convenience and the protection of
the health and safety of the inhabitants of the City of Lubbock requires and
makes it necessary that Toledo Avenue be extended and opened South at its
intersection with the Panhandle and Santa Fe Railway Company right of way
in the City of Lubbock as more particularly shown on the Official Map of
said City on file in the City Engineer's Office of the City of Lubbock; and,
WHEREAS, in order to extend and open said Toledo Avenue South
it is necessary that a grade crossing be established over and across the right
of way of the Panhandle and Santa Fe Railway Company; NOW THEREFORE,
. BE IT. ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION I. THAT Toledo Avenue be extended and opened South of
its present limits as more particularly shown on the Official Map of the City
of Lubbock on file in the City Engineer's Office of said City, to which Map
reference is heremade for a more particular description of said street, and
said Map is made a part hereof for such purpose as though fully copied herein.
SECTION 2. THAT the Panhandle and Santa Fe Railway Company BE
and is hereby requested to forthwith establish a grade crossing to accommodate
pedestrian and vehicular traffic at the point and location of an extension and
opening of Toledo Avenue South over and across the right of way of said
Panhandle and Santa Fe Railway Company at the point and location of said
Toledo Avenue more particularly described in Section 1 hereof and to provide
in connection with said grade crossing, the usual customary and necessary
warning and safety devices protecting the property and safety of the pedestrian
and vehicular traffic over and across the grade crossing here requested and
ordered.
. SECTION 3. THAT the City Secretary BE and she is hereby authorized
and directed to have published the descriptive caption hereof as provided by
law.
SECTION 4. THAT public necessity and convenience to . .pr.e.sexv.e th"P-~ ...
safety, welfare and property of the citizens of Lubbock requires the immediate
passage of this Ordinance, a~d thereby creates an emergency making it necessar

that the rule requiring an ordinance to be read on two separate occasions be
suspended, and the same is hereby suspended and this Ordinance shall take
effect and be in force from and after its passage.
AND IT IS SO ORDERED ..
