VEW:gb ,.. 2/5/58 o~-t3-t95~­ oRDINANcE NO. 23ga AN ORDINANCE PROVIDING FOR A MORATORIUM ON AND/OR THE DELAYiNG OF THE GRANTING OF BUILDING PERMITS DURING THE PLAN- NING STAGE OF THE CORONADO URBAN RENEWAL PROJECT AND THE YELLOWHOUSE URBAN RENEWAL PROJECT IN THE CITY OF LUBBOCK,.. TEXAS; PROVIDING FOR AN APPEAL FROM THE DECISION OF THE BUI.ID- lNSPECTOR; ESTABUSHING A GENERAL POUCY RELATIVE TO BUILDING PERMITS AS HEREAFTER SET FORTH IN THE BODY OF THIS ORDINANCE; AND DECLARING AN EMERGENCY AND PROVIDING FOR THE EFFECTIVE DATE OF TFnS ORDINANCE. WHEREAS, in Southeast Lubbock the areas designated and described as YELLOWHOUSE URBAN RENEWAL PROJECT AREA and CORONADO URBAN RENEWAL PROJECT AREA are at the present time in the planning stage as provided by the Ur·ban Renewal Law of Texas; and the City Commission finds that a proper completion of the planning in the public interest requires that no Building Permits be issued in either project area during the planning stage of development until plans for .the areas have been developed and processed as required by law and recommended by the Urban Renewal Agency and approved by the City Commission following approval by the Planning and Zoning Commis- _~sion as to zoning and street locations, among other things; and, rt W~REAS, the City Commission further finds that the planning of both areas is being expeditiously accomplished and delaying the granting of Building Permit~ will not only permit proper planning, but will also avoid excessive public expensE and private loss and inconvenience in causing new construction to be demolished, removed, modified or otherwise changed to fit into the proposed plan for the respective areas; and, WHEREAS, the City Commission is further of the opinion that the Urban Renewal Act contemplates a moratorium on the issuance of Building Permits to avoid the conflicts mentioned and unwarranted waste; and, WHEREAS, the City Commission finds that the immediate preservation of the public peace, property, health, and safety require that this Ordinance be passed as an emergency measure to expeditiously facilitate the proper planning and/or orderly development of the CORONADO URBAN RENEWAL PROJECT AREA and the YELLOWHOUSE URBAN RENEWAL PROJECT AREA; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1,. THAT the Building Inspector of the City of Lubbock is directed to take notice of all provisions of this Ordinance and is hereby restrained from issuing Building Permits or other permits related to new improvements and repairs and structural repairs in the YELLOWHOUSE URBAN RENEWAL PROJECT AREA and the CORONADO URBAN RENEWAL PROJECT AREA until hereafter authorized by the City Commission, to advise all applicants for any such permits of the existence of this Ordinance and the reasons therefor, giving such information and referring applicants to the Executive Director of the Urban Renewal Agency of the City of Lubbock for full information regarding planning for such area. ,, , SECTION 2. Should any applicant consider himself aggrieved by reason of the provisions here established or referred to in connection with planning for either area, he shall have the right and the privilege i~> hereby granted to appeal from the action of the Building Inspector to the City Commission within thirty (30) days from the date the Building Inspector denies his application for a permit SECTION 3. The City Commission hereby establishes the policy in the public interest to timely consider each appeal from actions of the Building Inspector in denying permits and make further investigation in connection with the planning of each project area and should the application substantially comply with the planning for the project involved, it will issue or cause to be issued a Building Permit modified as necessary, so as to fully comply with the proposed project plan. SECTION 4. THAT the rule requiring that this Ordinance be read two successive times before its final passage is hereby suspended, and this Ordin- ance shall take effect immediately from and after its passage.
