HomeMy WebLinkAboutOrdinance - 2383-1958 - Amending Zoning Ordinance 1695 And Official Map Of City Of Lubbock - 01/09/1958ORDINANCE NO. 2383 -----0' -;;13 -~ 5<Q AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1695 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK SO AS TO MAKE THE FOLLOW- ING CHANGE: ZONE CASE NO. 673 -CHANGE LOTS 3 AND 4, BLOCK 1, WESTWOOD DIOVEAUDIT'ION"'T'O"TTIE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, FROM AN "R-2" TO AN "R-3" ZONING DISTRICT. (VICINITY OF 21ST STREET AND KNOXVILLE AVENUE); SUBJECT TO THE FOLLOWING CONDITIONS: 1. THAT THE PRO RATA SHARE OF RIGHT-OF- WAY NECESSARY TO PROVIDE A WIDTH OF 60 FEET ON 21ST STREET BE DEDICATED. 2.. THAT THE PARKING LOT BE LOCATED AT THE REAR OF THE BUILDING, AND THERE BE NO PARKING IN FRONT OF THE BUILD- ING SETBACK LINE. 3. THAT A SOI.J..q.SEVEN FOOT SCREENING WALL OR FENCE BE CONSTRUCTED OF MASONRY, OR THE EQUIVALENT,. ALONG THE REAR OF THE PROPERTY (EXCEPT FOR DRIVEWAY .OPENING). 4. THAT THE AREA IN FRONT OF THE BUILDING BE LANDSCAPED. WHEREAS, the proposed change in zoning districts as hereinafter made has been duly presented to the Zoning and Planning Commission for its recommendation, which was received by the City Commission and after due consideration, the City Coxpmission finds that making th.e proposed change as hereinafter set out will be in the public interest; and, WH~REAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, as well as giving notices in compliance with Section 20 of Ordinance No. 1695 as well as notices provided by Article 1011£, Vernonts Annotated Civil Statutes, amended in 1953 and notice was duly published in the Lubbock Morning Avalanche more than fifteen (15) days prior to the date of the public hearing before the City Commission on such proposed amendment. and the public hearing according to said notice was duly held in the City Commission Room on the first floor of the City Hall, Lubbock, Texas, at which time persons appeared in support of the proposal; and. after said hearing, it was by the City Commission deter- mined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and Zoning Map be amended in the manner hereinafter set forth in the body.of this Ordinance and this Ordinance having been introduced in final written form prior to first reading hereof; NOW, THEREFORE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION I. THAT Ordinance No. 1695 and the Official Zoning Map BE, and the same are hereby amended as follows, to-wit: ZONE CASE NO. 673: Change Lots 3 and 4, Block 1, Westwood Drive Additi'O"il"to-the Cityof Lubbock, Lubbock County, Texas, from an "R-2.11 to an "R•3" zoning district,. {Vicinity of 21st Street and Knoxville Avenue); subject to the following conditions: 1. That the pro rata share of right-of-way necessary to provide a width of 60 feet on 21st Street be dedicated. /J-·.... . 11,... 2.. That the parking lot be located at the rear of the building, and there be no parking in front of the building setback line. 3. That a solid seven foot screening wall or fence be constructed of masonry, or the equivalent, along the rear of the property -{Except for driveway opening}. 4. That the area in front of the building be landscaped. SECTION 2.. THAT from and after passage and effective date of this Ordinance,. said lots, tracts and parcels of land described in Section 1 hereof shall be changed o the Zoning District indicated and the Official Map is amended in accordance herewith.
