AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF
LUBBOCK. TEXAS. P·URSUANT TO SECTIONS 5 AND 16 (a) OF THE URBAN
RENEWAL LAW OF TEXAS; PROVIDING FOR THE FORM OF NOTICE
THEREOF AND OF BALLOT FOR USE IN SAID ELECTION;AND DECLARING
AN EMERGENCY AND PRESCRIBING THE EFFECTIVE DATE OF THIS
ORDINANCE.
WHEREAS~ pursuant to a Resolution duly adopted on the Z2nd day of
August, 1957t and a notice duly published in the August Z5, 1957 and September
1, 1957 issues of the Lubbock A valanche-Journal» in the City of Lubbock,
Lubbock County, Texas (the official newspaper of the Ci~ty of Lubbock) in
accordance with said Resolution. the City Comrnissfon of the City of Lubbock,
Texas, on the 2.5th day of October., 1957~ at 9t00 A. M. C. S. T. met at
City Hall in Lubbock, Texas and held a public hearing on the question of
whether or not said City Commission will order an election, as required by
the urban renewal law of the State of Texas, to determine if. the City Com-
mission should adopt a certain :resolution under said urban renewalla)V, sub ~ ~ stantially in the form set forth in the form of notice contained in Section 4 -
hereof; and,
WHER.EAS, after due consideration of said questions and of the matters
presented at said public hearin&, the City Commission has determined to
call said election; and,.
WHER.EAS, slum and/ or blight conditions exist in various areas of the
City of Lubbock which immediately imperil the public peace, property., health,
and safety which creates an emergency; NOW• THEREFORE,.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
SECTION 1. THAT In accordance with the provisions of the Urban Renew-
al Law of the State of Texas, including, particularly, Section 5 and 16 (a) thereof
a special election within the corporate limits of the City of Lubbock., Texas, is
hereby ordered to be held on the 2.6th day of Noveptber~ 1957, to determine
whether the City Commission should adopt a resolution substantially in the
form set forth in the form of notice contained in Section 4 hereof, .
SECTION 2.. Only legally qualified voters residing within the corporate
limits of the City of "Lubbock., owning taxable property within said corporate
limits who have duly rendered such property for taxation. .shall be entitled to
vote at said election.
SECTION 3. Except as otherwise provided herein. said election shall be
held and conducted during the hours and in the manner, and the ballots cast
shall be canvassed and the returns made and the results declared, all sub-
stantially as required by the applicable provisions of the Constitution and laws

of the State of Texas and the Charter and ordinances of the City of Lubbock
with respect generally to special elections in said City.
SECTION 4. The City Commission of the City of Lubbock hereby orders
that at least thirty day•s notice of the special election herein ordered shall
be given in the manner required by the applicable provisions of the laws of
the State of Texas and the Charter and ordinances of the City of Lubbock with
respect generally to special elections in said City. The notice to be given shall
be as follows:

Pursuant to the applicable provisions of the laws of the State
of Texas and the Charter and Ordinances of the City of Lubbo~
including particularly, the Urban Renewal Law of the State, notice
is hereby given that a special election will be held in said City on
the Z6th day of November, 1957 from 1100 A. M. to 7:00 P. M. •
to determine whether the City Commission of said City shall adopt
a Resolution substantially as follows:

URBAN RENEWAL LAW OF TEXAS.
1BE IT RESOLVED BY THECITY COMMISSION OF THE CITY OF
L UBBOCKJ., TEXAS• AS FOLLOWSt
'SECTION 1. It is hereby found and determined that one or more
slum or blighted areas exists in the City of Lubbock.
1SECTION Z. It is hereby further found and determined that the
rehabilitation, conservation, or sluzn clearance and redevelopment
o.r a combination thereof~ of such slum or blighted area or areas,
is neces.sary in the inter~st of public health, safety, morals or
welfare of the residents of said City.
'SECTION 3. It is hereby further determined that the City of
Lubbock shall exercise the powers granted to the City by the Urban
Renew.a.l Law of the State of Texas, except the Urban Renewal Project
Powers as defined in said Urban Renewal Law.

'SECTION 4. It is hereby further determined to be necessary
and in the public interest that the City of Lubbock elect~ and, accordingly,
the City hereby elects to have sai d Urban Renewal Project Powers
exercised by the Urban Renewal Agency of the City of Lubbock,. whj.ch
agency is created by said Urban Renewal Law.
'SECTION 5. The findings. determinations, and elections herein
made are made in accordance with and the various terms used herein
are used in the same sense as used or defined in said Urban Renewal Law. t
Only legally qualified voters residing within the corporate limits
of said ·City:r. owning taxable property within said corporate limits. who
have duly rende.red the same for taxation. shall be entitled to vote at
said special election.

The Chief of Police is hereby directed to poat a properly executed copy
of this Election Ordinance together with the notice of election herein prescribed
at the following places:
Carroll Thompson Junior High School
0. L. Slaton Junior High School
Dunbar High School
College Avenue Fire Station
J. T. Hutchinson Junior High School
Zenith Avenue Fire Station
Lou Stubbs School

The City Secretary ,hall serve a duly ~ertified copy of this Ele.ction
Ordinance upon the .Judges and Assistant Judges as ntuned and shown on
Exhibit "A11 which is attached to and made a part of this Ordinance (as hereafter
provided in Section 7 hereof). Such service shall be made by registered mail
within twenty (20) days after the effective da~e of this Ordinan~e.
The Mayor shall, fifteen (15) days prior to the special election herein
provided for~ notify each presiding judge in writip.g of his duty to hold said
election in that precinct.
SECTION 6• The form of ballot which shall be used in said special
election shall be substantially as follows:

SECTION 6. The City Secretary is hereby authorized and directed to
cause to be printed, and at the proper time., to be made available at all polling
places within said City, an adequate supply of the official ballot herein prescribed
for use at said special election., substantially in accordance with the applicable
provisions of the laws of ·-Texas and the Charter and ordinances of the City of
Lubbock with respect generally to special elections in said City.
SECTION 7. Said special election shall be held at the places shown on
the attached schedule which is marked "Exhibit A", which "Exhibit A11 is
attached hereto and made a part hereof, said special election shall be held in
accordance with the applicable pr.ovisions of the Election Code of the State of
Texa.s::t the Urban Renewal Law of the State of Texas and the Charter and ordinanc
of the City of Lubbock.; and the pers.ons named and shown in said 11Exhibit A 11 are
e.r eby appointed judges. assistant judges and clerks11 respectively and designated
and authorized to hold said special election at the place indicated on said
"Exhibit A 11•
SECTION 8. Whereas, public necessity requires that this Ordinance be
passed as an emergency measure .as defined in the preamble of this Ordinance•
the rule requiring that ordinances be read two times before passage is hereby
suspended and this Ordinance shall become effective on October 25, 1957.
