ORDINANCE NO. 2270 AN ORDINANCE ESTABLISlfiNG BUILDING LINES ON THE N=O~R~T~H!.-AN-:---D-=- SOUTH SIDES OF 50TH STRE~T AT THE PLACE .AND LOCATION AS MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS IN THE BODY OF THIS ORDINANCE; PROVIDING THAT NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTEDa RE-ERECTE.Da OR SUBSTANTIALLY REP.AIRED BETWEEN SUCH BUILDING LINES; REQUIRING EXISTING STRUCTURES ON OR BETWEEN THE BUILDING LINES HEREIN ESTABLISHED TO CONFORM TO SUCH B.UlLDING LINES WITHIN FIVE (5) YEARS; DEFINING BUILDING LINE AND PROVIDING THAT SET BACK REQUIREMENTS UNDER THE CITY'fS ZONING ORDINANCE AND AMENDMENTS THERETO BE DETERMINED FROM THE BUILDING LINES HEREIN ESTABLISHED; PROVIDING EXCEPTIONS FOR UTILITY EXTENSIONS AND PUBLIC IMPROVEMENTS; PROVIDING A SAVINGS CLAUSE. WHEREAS~ Article 1105a Revised Civil Statutes of Texa• provides for the establishment of building lines on any part or side of any street in the City of Lubbock, said City of Lubbock having a population o£ more than 15. 000 per sons, and, WHEREAS, the City Commission finds that public convenience, safety and necessity in the City of Lubbock require that building linea or rights-of-way lines be established on the North and South sides o£ 50th Street at the place and location more particularly described by metea and bounds in the body of thia ordinance, to prevent repair and replacement o£ structurea and trees in the area between the building lines as established, such areas being required in connection with widening, opening, and improving that part of 50th Street as hereinafter de scribedt and, WHEREAS, the widening and improving of 50th Street and the establishement of such building lines are necessary and will ultimately provide streets of desirable and adequate width which will aid and relieve heavy traffic in congested areas in accordance with the City1s comprehensive plan, and the City's Planning Commission has recommended such plan. The City Commiasion fu:rther finds that such establishment of building lines at this time will promote economy, NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT a building line is hereby established on the North and South sides of 50th Street at the place and location as hereinafter described and within the corporate boundaries of the City of Lubbock, which North and South / building lines are more particularly described as follows~ to-wit: NOR.TH SIDE BEGINNING at a point Z89. 9 feet east and 60 feet north of the southwest corner of Section 6, Block B. Lubbock County a. Texas, said point being 10. 0 feet north oft~ beginning point of the north building line as established by Ordinance 2134. THENCE east with a line 60.0 feet north and parallel to the south I line of Section 6~ Block B and Section 4~ Block B a distance of 9355. 1 feet more or less to the west right-of-way line of Southeast Drive. SOUTHSIDE BEGINNING at a point 2.89. 9 feet east and 60. 0 feet South of the Northwest corner of Section 1, Block .E~ Lubbock County1 Texas, said point being 10.0 feet north of the beginning point of the south building line as established by Ordinance 2.134. THENCE east with a line 60. 0 feet south and parallel to the north line of Section 1, Block E 11 Survey 2.3 Sl Johnston Block R. and Section 2.1 BlockS a distance of 9455.0 feet more or leas to the west right-of-way line of Southeast Drive. SECTION 2.. THAT no building or other structure shall hereafter be erected, re-erected or substantially repaired and no new structure or parts thereof shall be erected on that part of the street or land herein designated within said building lines hereinabove described. SECTION 3. THAT all structures on or between the building lines established by thia·Ordinance o.r extending in whole or in p.rt within such building linea are hereby required to conform to the new building lines established in Section One (1) of this Ordinance within five (5) years from the effective date of this Ordinance. SECTION 4 . The term nBuilding Line11 as herein used shall be construed to mean 11street right-of-way line11, and the setback requirements under the C1tyf· Zoning Ordinance and all amendments thereto shall apply in addition to the right- of-way lines or building lines herein establishect_ .. it being the intent and purpose of this Ordinance to preserve all land within the building lines. herein established for ultimate street purposes. SECTION 5. The provisions of this Ordinance shall not apply to any officer, agent:t employee or other person duly authorized by the State of Texas and/o.r the City of Lubbock when performing any employment pursuant to the widening~ straightening or extension of the street and/or the right-of-way contemplated by this Ordinance or authorized utility extensions within the right-of-way he rein described. SECTION 6. lf any sectio~ paragrap~ subdi visiona clause, phrase or provision of this Ordinance shall be judged .invalid or held unconstitutional, the same shall not affect the validity of the remainder of this Ordinance as a whole o any part of provisions thereof other than the part so decided to be invalid or unconstitutiqnal.
