HomeMy WebLinkAboutResolution - 2019-R0331 - Bingo Prize Fees - 09/24/2019 Resolution No. 2019-R0331 Item No. 6.8 September 24,2019 RESOLUTION WHEREAS,the City of Lubbock is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, House Bill 914, which was recently passed by the 86`x'Texas Legislature, provides that local governments will no longer receive their bingo prize fee payments from the Texas Lottery Commission at the end of the fiscal year as is the current practice, but instead,the licensed organization conducting bingo in the local jurisdiction will be responsible for sending eligible local governments 50%of the prize fees they collect on a quarterly basis; and WHEREAS, in order to continue receiving a percentage of bingo prize fees collected after January 1,2010,the City must: 1) approve to do so by majority vote through this resolution, 2)notify the Texas Lottery Commission before November 1, 2019 of the City decision to continue receiving bingo prize fees; and 3) notify each licensed authorized organization conducting bingo within the City's jurisdiction of the continued imposition of the fee; and WHEREAS,the City Council previously imposed a gross receipt tax on licensed authorized organization conducting charitable bingo on December 15, 1983; and WHEREAS, by majority vote,the City Council by this resolution has elected to continue to receive its share of bingo prize fees collected by licensed authorized organizations; and WHEREAS,the City shall inform each licensed authorized organization conducting bingo operations within the City's jurisdiction of the continuation of the collection of the prize fee; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the City Council has decided to continue receiving a percentage of bingo prize fees collected within its jurisdictional limits and directs staff to make the necessary notifications pursuant to HB914; SECTION 2.
