AN ORbiNANCE ESTABLISHING BUILDING LINES ON THE NORTH
AND SOUTH SIDE OF 50th STREET FROM THE EAST CITY LIMIT LINE TO
THE WEST CITY LIMIT LINE, AS MORE PARTICULARLY DESCRIBED BY
METES AND BOUNDS J,N THE BODY OF THIS ORDINANCE• PROVIDING THAT
NO BUILDING OR OTHER STRUCTURE SHALL HEREAFTER BE ERECTED,
RE-ERECTED OR SUBSTANTIALLY REPAIR~D BETWEEN SUCH BUILDING
LINES; REQUIRING EXISTING STRUCTURES ON OR BETWEEN THE BUILDING
LINES HEREIN ESTABLISHED TO CONFORM TO SUCH BUILDING LINES
WITHIN FIVE {5) YEARS; DEFINING "BUILDING LINE" AND PROVIDING THAT
SETBACK REQUIREMENTS UNDER THE CITY'S ZONING ORDINANCE AND
AMENDMENTS THERETO BE DETERMINED FROM THE BUiLDING LINES
HEREIN ESTABLISHED, PROVIDING EXCEPTIONS FOR UTILITY EXTENSIONS
AND PUBUC IMPROVEMENTS; PROVIDING A SAVINGS CLAUSE; REPEALING
ALL ORDINAN.CES ESTABLISHING BUILDING Ll'NES WHICH CONFLICT WITH
THE BUILDING LINES ESTABLISHED HEREIN.
WHEREAS, Article 1105a, Revised Civil Statutes of Texas provides for
the establishment of building lines on any part or side of any street in the City
of Lubbock, said City of Lubbock having a population of more than 15, OOO;.and,,
WHEREAS, the City Commission finds that public cqnvenience, safety,
and necessity in the City of Lubbock requires that building lines or right-of-way
lines be established on the North and South side of 50th Street from the East City
Limit Line to the West City Limit Line to prevent repair and replacement of
structures and trees in the area between the building lines so established, such
areas being required in connection with the widening, opening and improving
that part of 50th Street described more particularly hereinafter in the body of
this Ordinance; and,
WHEREAS, the widening and the improvement of said 50th Street and
the establis~-cmt of such building lines are necessary and will ultimately provide
streets of desirable and adequate width which will aid in relieving heavy traffic
in congested areas in accordance with the City's comprehensive plan and the
City Planning Commission has recommended such plan. The City Commission
further finds that such establishment at this time will promote economy• and,
WHEREAS, the City Commission finds there are building lines on 50th
Street which conflict with the building lines established herein and such conflicting
building line ordinances should be repealed; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUB.BOCK:
SECTION 1. THAT a building line is hereby established on the north
and south side of 50th Street from the East City Limit Line to the West City Limit
Line, and within the corporate boundaries of the C ity of Lubbock, which North
and South building lines are more particularly described as follows, to-wit:
NORTH SIDE
BEGINNING at a point in the East City Limit Line, said City Limit
Line established by Ordinance #1946 an d said point being 50 feet
North and 289.9 feet East of the Southwest corner of Section 6,
Block B;

SECTION z.. THAT no building or othl!r structure shall hereafter be
erected, re-erected or substantially repaired and no new strl?-ctu.r~ or parts
thereof shall be erected o.n that part o£ the street or land h~rein designated within
said building lines hereinabove described. ·
SECTION 3. THAT alJ. structures on or between the building lines estab-
lished by this Ordinance or extending in whole or in part within such building lines
are hereby required to conform to the new building lines established in Section One
{1) of this Ordinance within five (5) years from the effective dat~ of this Ordinance,
SECTION 4. The t.erm ·•Building Line11 as herein used shall be construed
to mean "street right-of-way line," and the seth.ck requirem,-:nts under the City's
Zoning Ordinance and all amendments breto shall apply in addition to the .right•
of-way lines or building lines herein established, it being the intent and purpose
of this Ordinance to preserve all land within the building lines herein established
for ultimate street purposes.
SECTION 5. The provisions of this Ordinance shall not apply to any
officer, agent, employee or other person duly authorized by the .State of Texas
and/or the City of Lubbock when performing any employment pursuant to the
widening, straightening or extension of the street and/or the right-of-way contem-
plated by this Ordinance or authorized utility e.xtensions within the right-of•way
herein described.
SECTION 6. If an:y section, paragraph, subdivision, clause, phrase ~
Provision of this Ordinance shall be judged invalid or held unconstitutional, the
same shall not affect the validity of the remainder of this Ordinance as a whole
or any part or provision thereof other than the part so decided to be invalid or
unc on s ti tu tional.
SECTION 7. Building Line Ordinances Nos. 1059, 1097, 1388, 1950 and
1977 are hereby repealed and declared to be of no further force and effect and
~he City Secretary is hereby instructed to note in the tlla.rgin of the Ordihance
!Books that such Ordinances have been repealed by this Ordinance. '
