TEXAS., GRANTS THE LUBBOCK NATIONAL BANK. INCORPORATED, ITS SUCCESSORS AND ASSIGNS, THE RIGHT TO BUILD OVER THE PUBLIC ALLEY EXTENDING EASt AND WEST THROUGH BLOCK 104 OF THE ORIGINAL TOWN OF LUB- BOCK, LUBBOCK COUNTY, TEXAS• AND OVER THE lNTERSECTION OF THE PUBLIC ALLEY EXTENDING EAST AND WEST WITH THE INTERSEC"" TION OF THE PUBLIC ALLEY EXTENDING NORTH AND SOUTH,. ALL IN BLOCK 104, THE ORIGINAL TOWN OF LUBBOCK. LUBBOCK COUNTY • TEXAS, AND TO JOIN THE UPPER STORIES OF THE BUILDINGS NOW ON OR HEREAFTER ERECTED ON THE PROPERTY THAT THE LUB- BOCK NATIONAL BANK. INCORPORATED. ITS SUCCESSORS OR AS• SIGNS OWNS ON LOTS 6 THROUGH 10, AND LOTS 16 THROUGH ZO ON EACH SIDE OF SAID PUBLIC ALLEYS lN BLOCK 104, ORIGINAL TOWN OF LUBBOCK. LUBBOCK COUNTY, TEXAS; AND PROVIDING CONDI- TIONS OF THIS GRANT .. WHEREAS, there extends East ... West and North-8outh, public alleys through the Original Town of Lubbock, Texas, and the Lubbock National Bank, Incorporated, ha$ a building used in connection with its banking bus ... iness, located on Lots 6 through 10 in Block 1Q4, and now owns Lots 16 through ZO in said Block 104 and proposes to erect a parking building there• onJ and Lots 6 through 10 are South of the East-West alley and West of the North-south alley, and Lots 16 through ZO are North of said East•W·est alley and East of said North-South alley; and~ WHEREAS, it is deemed necessary by the Lubbock National Bank. Incor- porated to erect a new building on Lots 16 through ZO and to connect said building with the building now erected on Lots 6 through 10~ and, WHEREAS. it is deemed necessary to connect said buildings over said East ... West and North-South alleys• NOW• THEREFORE. BE IT ORDAlNED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: THAT the Lubbock National Bank, Incorporated~ its successors and assigns are hereby authorized and granted the right to build a connection and walkway over and along the public alley extending East-West throUjh Block 1()4 of the Original Tow:n of Lubbock. and over the intersection of the East•Weat and North-south alley of said Block 104, and to join and connect a wadkway between the upper stories of the building now erected on Lots 6 through 10 with the building tC? be erected on Lots 16 through ZO in Block 104 of the Original Town of Lubboc~ Texas. There shall be a clearaage over .said alley of not less than 38 feet above the surface thereof, and the connection and walkway be- tween the upper stories of said buildings shalll be not m•ne than approximately 4 feet in width and not m"re than approximately 10 feet in height. This grant is made subject to the conditions that should the Lubbock Nat ... ional Ban~ Incorporated, .its successors and assigns accept this. grant or exercise any rights under the ;arant here made, and prepare or begin or complete that part of the structure herein contemplated to be placed above the above set out alley surface, said Lubbock National Bank, Incorporated, its successors or assigns will at all times defend and otherwise hold the ·< City of Lubbock, its agents, servants and employees, harmless. from any and all claims, demands, d&mages, actions, causes of actions, suits at law ·::>r in equity, of whatsoever kind or nature which rnc"'.y grow out of or be related to the making of this grant,. or the construction, erection or maintenance of the structure and any appurtenances herein contemplated. The Lubbock National Bank, Incorporated shall in the exercise of this grant provide for the adjustm\!nt or moving of any utilities located in the a'tJa to ~e occupied ~y the structure herein authorized without cost to the City of Lubbock. We would like permiesion to construct a ramp from the fitth floor ot this proposed pe.r.IU.ng building to the fourth t"loor of the .wbbock Rational Bank building. This ramp would be 4o• above the ground, diagonal.ly across the alley running east and west. The prilary use of this raarp vould be to provide passageway from the parking buildina to the bank 's office buil ding. We have discussed the matter with the Southwestern Public Service Company with reference to this ramp and they will cooperate with ua and have no objections to the ramp being constructed. It ia expected that we will have a letter t o present to you from them regarding their attitude in the matter of this ramp. ·It is our understanding that only the wires of the Southwestern Public Service ~ would be &rrected by the construction of this ramp. It is contemplated that the matter wil l be presented to you 'by ua in person at your Commission meeting to be held on May loth, at Wieb time our proposed ramp and parking building Will be tu.U.y explained.
