HomeMy WebLinkAboutOrdinance - 2173-1957 - Authorizing A Charge For Furnishing Copies Of Accident Reports By The Police Dep - 03/28/1957( c ( .__ 0 3-::>6-1.95"1- 0RDINANCE NO. 2!73 AN ORDINANCE AUTHORIZING A CHARGE FOR FURNISHING COPIES OF ACCIDENT REPORTS BY THE POLICE DEPARTMENT OF THE CITY OF LUBBOCK; PROVIDING FOR THE COLLECTION AND DISPOSITION OF SUCH CHARGES, PROVIDING AN EMERGENCY. t; WHEREAS, heretofore the Police Department has been furnishing copies of investigating officers' reports on accidents to interested persons without chargel and, WHEREAS,. the cost of providing such copy work has increased to such .an extent as to create an emergency and to becom·~ a burden on the Police Department; and, ,· WHEREAS, the City Commis~ion finds it would be to the public interest to establish a reasonable charge for ihe furnishing of such documents in order that the cost of furnishing such documents be self-sustaining; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. The Chief of Police is hereby authorized to furnish a copy of the police invesigation report, made by the investigating officers at the scene of an automobile accident, to the following persons onlyJ to any party involved in an accident., either as driver, passenger or as a person whose property has been da1naged as the result of an automobile accident; to a representative of the insurance carrier for any of the above mentioned persons; to the attorneys of any of the above mentioned persons or their insurance carrier. SECTION Z. THAT there BE and is hereby authorized a charge of ONE DOLlAR ($1. 00) per copy for each copy of the investig;t.ting officers1 report of investigation made at the scene of an automobile accident, to any of the above named persons. Such charge to be paid in cash to the Chief of Police or his representative and shall be deposited in the general fund of the City of Lubbock. SECTION 3. The authorization set out in. Section 1 shall apply only to the report made by the investigating officers concerning an automobile accident, and shall not include any written statement obtained from any person, and shall not include any report, whether required to be made by law or not, made by any person involved in any way in an automobile accident. Whereas, an emergency exists as shown by the preamble to this Ordinance; the enactment of t~ ordinance is. declared to be an emergency measure providing for the usual daily operation of the Police Departxnent, c c and the rule requiring more than one reading is-hereby ~uspended and this ordinance 13hall be effective from and after the date of its passage.
