RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
for and on behalf of the City of Lubbock, a Research and Demonstration Project Grant
Funding Agreement, by and between the City of Lubbock and the High Plains Underground
Water Conservation District No. 1 for assisting non-profit organizations and residential
homes with the proper installation and utilization of rainwater harvesting systems, and related
documents. Said Agreement is attached hereto and incorporated in this resolution as if fully
set forth herein and shall be included in the minutes of the City Council.

I. This agreement is entered into between High Plains Underground Water
Conservation District No. 1- (HPWD) and the City of Lubbock, TX. ("grantee").
2. HPWD wishes to promote water conservation research and demonstration projects
that benefit the residents of the district. Certain funds have been dedicated to
accomplish this purpose. In accordance with the HPWD Research and Demonstration
Policy, the policy committee has reviewed the project and has determined that it is
consistent with this purpose.
3. The grantee acknowledges receipt of the HPWD research/demonstration policy and
will adhere to its provisions.
4. The grantee shall deliver a progress report to the HPWD general manager no later
than July 1, 2020. The progress report shall include:
■ Successes or setbacks observed with the project.
■ Conservation impacts to the District.
■ Budget and expense report showing how the grant funding was spent.
S. The HPWD Board of Directors requires a progress report/final report to be presented
at one of its regular monthly meetings during the 2020 fiscal year.
6. Grantee will share all data, findings, conclusions and reports with HPWD. HPWD shall
be allowed to review all such information at any time it is requested.
7. All news releases, news articles, or other information submitted to the media or other
outlets relating to the project will be forwarded to HPWD for review/comment prior
to release. All such media information shall recognize HPWD as a sponsor of the
project.
This agreement is entered into this, the g4th day of September 2019.

Amendment to Grant Funding Agreement
Article IV (1) of the HPWD Grant Funding agreement states that "this agreement may be altered
or amended by mutual written consent of the parties."
In a December 6, 2021 email, Raquel Mullin requested a no -cost extension of the 2019 project,
"City of Lubbock Rainwater Harvesting Development Project."
Exhibit A of the City of Lubbock's grant funding agreement states, "the scope of our outreach
rainwater harvesting development project is proposed for two years starting October 1, 2019
to September 30, 2021."
As noted in the October 2021 final report and Ms. Mullin's October 12, 2021 presentation to
the HPWD Board of Directors, the City of Lubbock has three rainwater harvesting barrels and
three commercial cisterns remaining for distribution to eligible applicants. Implementation of
this program was delayed due to the COVID-19 pandemic. The City of Lubbock requests an
extension of time in order to distribute the remaining rainwater harvesting equipment, which
will bring the project to completion.
As a result, both parties do hereby mutually agree to extend the program completion date to
April 30, 2022 as requested by the City of Lubbock.
All other agreements, general terms, and provisions set forth in Articles I — VII remain in effect
as previously agreed to in the original signed executed document.
This amendment to the original HPWD grant funding agreement is entered into this
28th day of December, 2021.
